why the nonsil phone 's state count is 3, sil phone 's state is 5?

That's been the default since the beginning, we were emulating a topology used at BUT.  I don't think we've done any recent experiments to see whether it helps or hurts... the differences would probably be small; mostly these days we just use the GMM systems to boostrap neural nets, and those use a different topology anyway.

Doesn't it kind of mess with short silences since I would assume it then can't handle silences shorter than 50ms?

No, it has a different topology so you can still traverse it in 3 frames.
