Please find attached a briefing paper that Ralph Regenvanu and I have prepared in relation to the proposed land law amendments that will be tabled in Parliament in Vanuatu next week.

 

You will see from the briefing note that there are some significant concerns with the package of amendments namely that:

 

  1. They reinstate the power of the Minister to sign again on behalf of custom owners, the basis of historical abuse of powers and widespread leasing without the consent or knowledge of the custom landowning group.

 

  1. They substantially remove the capacity of nakamals to identify custom owners. This was requested repeatedly in consultations related to the drafting of this legislation.

 

  1. They significantly restrict custom owner rights, including even the right to be recognised as having an recognised interest in land.

 

 

All details are included in the briefing document attached.

 

At present there is little public awareness in Vanuatu around these amendments and their implications.
