In India, there is a negative general perception that the law, regulations and enforcement agencies are not in favour of Intellectual Property Generators & Holders unlike the developed countries, it may not be completely true.
In an organizational level Patent, Design, Copyright etc. may not be used only for enforcement; rather they can be used in many ways such as Deterrent to Competition, Market Differentiator, Value Proposition, Marketing Tool, Increasing Value of the company etc. These IPs come with many benefits such as Increased Value, help in availing larger financial bandwidth as well as better bargain at the time of Merger & Acquisition. Similarly a technology professional that invents/ innovates and subsequently protects the IPR in individual level or through organization can not only get the recognition inside & outside as an Inventor but also can get financial benefits and claim tax exemption on royalty amount. So, it would be an injustice to view IP practices in Indian Enforcement perspective alone. Moreover now the Technology business is not limited to boundary of any nation. May it be service or product, the whole globe is the market. And in every country the law is different as well as the legal environment.
In the present scenario of ever decreasing profit margin and ever increasing competition, individuals as well as enterprises have to be aggressive towards IPR & Innovation in both Product and Services. It should not be forgotten that ailing Nokia is getting $500 million per annum only from the licenses of its large Patent Portfolio. Similarly Motorola was bought by Google for $12.5 billion, mainly because of its IPR.
In one hand only 37,000 patents were filed in India (by mostly nationals of other countries), more than 300,000 patents were filed in China; surpassing patent filing US and Japan in 2011 for the first time. It is projected that China will be filing 500,000 patents in 2015.
So, to move to higher level in the value chain as an Individual or as an Organizational; to be prepared for Global Competition; there is an urgent need to Innovate & Protect.
