Le Comité des Nations Unies pour l’Élimination de la Discrimination Raciale (CERD) demande au Maroc de prendre des mesures contre la discrimination raciale et exprime sa préoccupation sur la discrimination et la xénophobie contre les réfugiés et demandeurs d’asile ainsi que les non-ressortissants dépourvus de titre de séjours.
RABAT, 30 AOUT 2010 - Le Comité pour l’Elimination de la Discrimination Raciale, réuni les 16 et 17 août à Genève, dans le cadre de sa 77ème Session a examiné les 17ème et 18ème Rapports Périodiques du Maroc sur la mise en œuvre de la Convention Internationale pour l’Elimination de la Discrimination Raciale.
Dans ses observations finales rendus public le 27 Août 2010, le CERD, recommande au Maroc de consacrer dans sa constitution le principe de la primauté des traités internationaux sur sa législation interne, afin de lui donner une portée générale et de permettre aux justiciables d’invoquer devant les tribunaux les dispositions pertinentes de la Convention sur l’élimination de toutes les formes de discrimination raciale.
Le Comité recommande également au Maroc d’adopter une législation spécifique relative à l’interdiction de la discrimination raciale qui soit en pleine conformité avec l’article premier de la Convention et d’inclure dans son Code pénal des dispositions donnant pleinement effet à l’article 4 de la Convention, en particulier une incrimination spécifique sur la diffusion d’idées racistes. Le Comité recommande également au Maroc de prévoir dans sa législation pénale le motif raciste comme circonstance aggravante de la discrimination raciale.
Le Comité exprime sa préoccupation suite aux informations selon lesquelles les non-ressortissants dépourvus de titre de séjour, en particulier en provenance de pays sub-sahariens, sont victimes de discrimination raciale et de xénophobie, et sont souvent soumis a la détention arbitraire, le déni d’accès a la justice et le refoulement arbitraire. Le comité demande au Maroc de veiller à l’application de toutes les garanties juridiques relatives à leur détention, à la facilitation de leur accès aux tribunaux ainsi qu’à l’application correcte du principe de non-refoulement.
Le Comité recommande également au Maroc :
de promouvoir la législation relative à la discrimination raciale, d’informer la population, en particulier les catégories vulnérables, de toutes les voies de recours juridiques disponibles, de simplifier ces recours et de leur en faciliter l’accès ; et de prévoir dans sa législation le renversement de la charge de la preuve pour des faits de discrimination raciale en matière civile ;
de garantir un service d’interprétation, notamment en procédant à la formation de plus d’interprètes assermentés, et de s’assurer que des justiciables appartenant à des catégories vulnérables et ne parlant pas l’arabe, puissent bénéficier d’une bonne administration de la justice.
Le Gadem estime que le Maroc dispose d’une réelle opportunité pour mettre en œuvre les recommandations du CERD dans le cadre du chantier de la réforme de la justice et se joint au CERD pour réitérer sa demande au gouvernement marocain de prévoir dans ses efforts de formation aux droits de l’homme, des modules sur la lutte contre la discrimination raciale et de sensibilisation aux relations interculturelles, auprès des agents chargés de l’application des lois, notamment des personnels de police et de la gendarmerie, de la justice et de l’administration pénitentiaire.
Le Gadem, qui avait soumis un rapport au comité sur les discriminations subies par des personnes migrantes et des réfugiés, accueille avec satisfaction l’appel du CERD pour que le Maroc adopte un cadre juridique et institutionnel visant à clarifier les procédures d’asile et à garantir la protection des droits des réfugiés et des demandeurs d’asile, notamment en ce qui concerne l’accès à l’emploi et l’accès au logement, ainsi que leur protection contre la discrimination raciale. Le Maroc est appelé par le CERD à présenter ses dix-neuvième, vingtième et vingt-et-unième rapports périodiques soumis en un seul document, attendu le 17 janvier 2013 et à présenter dés 2011 des informations sur la suite qu’il aura donnée aux recommandations faites par le CERD, notamment, celles concernant l’adoption d’un cadre juridique et institutionnel visant à clarifier les procédures d’asile et à garantir la protection des droits des réfugiés et des demandeurs d’asile contre la discrimination raciale et la protection des non ressortissants dépourvus de titre de séjour contre le refoulement arbitraire.

The United Nations Committee for the Elimination of Racial Discrimination (CERD) urges Morocco to take measures against racial discrimination, expresses concern about discrimination and xenophobia against refugees and asylum seekers as well as non-citizens without residence permits
RABAT, 30 AUGUST 2010 – The Committee for the Elimination of Racial Discrimination, in meetings on 16 and 17 August in Geneva during its 77th Session, examined the 17th and 18th Periodic Reports of Morocco on the implementation of the International Convention on the Elimination of Racial Discrimination.
In its Concluding Observations issued 27 August 2010, CERD recommended that Morocco establish the principle of primacy of international treaties over domestic law in its constitution, in order to give it general effect and allowing parties to invoke the relevant provisions of the Convention on the Elimination of All Forms of Racial Discrimination in courts.
The Committee also recommended that Morocco adopt specific legislation on the prohibition of racial discrimination that is in full conformity with the article 1 of the Convention, and include provisions in its criminal code that give full effect to article 4 of the Convention, in particular the specific criminalization of the spreading of racist ideas. The Committee further recommended that Morocco provide in its criminal law that racist motive be an aggravating circumstance in racial discrimination.
The Committee expressed its concern regarding information that non-citizens without residence permits (« titre de séjour »), in particular those from sub-Saharan African countries, are victims of racial discrimination and xenophobia, and are often subject to arbitrary detention, the denial of access to justice, and arbitrary refoulement. The Committee requested Morocco to monitor the application of all legal guarantees related to detention for these non-citizens, the facilitation of their access to courts, as well as the correct application of the principle of non-refoulement.
The Committee also recommended that Morocco:
Promote legislation on racial discrimination; inform the population, in particular those in situations of vulnerability, of the available forms of judicial recourse; simplify these recourse and facilitate access to them; and to provide in Moroccan legislation the inversion of the burden of proof for facts on racial discrimination in civil matters.
Guarantee interpretation services, in particular by conducting training of interpreters under oath, and to assure that parties who are in situations of vulnerability and who do not speak Arabic can benefit from the good administration of justice.
Gadem consider that Morocco has a real opportunity to implement the recommendations of CERD in the framework of work to reform of the justice system. It joins CERD in reiterating the demand to the Moroccan government to, in its work to conduct human rights trainings, provide modules on the fight against racial discrimination and awareness-raising about multiculturalism, for agents who are charged with application of laws, in particular the personnel in the police and gendarmerie, the justice system, and the correction system.
Gadem, which submitted a report to the Committee on discrimination suffered by persons who are migrants and refugees, welcomes the call by CERD for Morocco to adopt a legal and institutional framework seeking to clarify asylum procedeures and guarantee the protection of the rights of refugees and asylum seekers, in particular with regard to access to employment and access to housing, as well as their protection against racial discrimination.
Morocco is called upon by CERD to present its 19th, 20th and 21th periodic reports in a single document by 17 January 2013, and to present information from 2011 regarding the follow-up that was given to the recommendations made by CERD, notably, those related the adoption of a legal and institutional framework to clarify asylum procedures, and the guaranteeing of the protection of the rights of refugees and asylum seekers against racial discrimination, and the protection of non-citizens without « stay permits » against arbitrary refoulements.
