to Joan Webster Murder
When the warrant was brought forward in December 1984, after the
Iannuzzi conviction, Burke attempted to forcibly remove splinters from
Paradiso's finger. He alleged they were from an injury caused in
murdering Joan Webster.
The warrant submitted by Trooper Andrew Palombo claimed Joan was
raped, hit with a whiskey bottle, and dumped in the ocean. This is a
distorted representation of the informant's statement that claimed
Joan was hit with the whiskey bottle, then raped, and dumped in the
ocean.
Palombo had requested a marine report which showed the rudder was
broken on the boat and it wasn't seaworthy. The theory was still
supported despite insurance and police reports that the boat was
missing in July 1981, months before Joan disappeared. There was
nothing to establish any claim the boat was above the water in
November. Palombo had seized the very item Paradiso said caused the
injury, corroborating Paradiso's account. Trooper Palombo submitted a
false warrant to the court.
Burke's argument at this time claimed there were several shards of
broken glass found on the boat. This is a false representation. He
produsced a photo of the cabin that showed liquor bottles, but no time
frame when it was taken. There were no bottles found on the boat. No
glass was submitted with items recovered from the boat. Divers
dredged up everything from the bottom to submit for testing. Among
those items, Burke submitted one thing he called glass that the lab
labeled as debris. It wasn't suitable for testing.
Trooper Dave Moran published that there was nothing found in 2 months
of diving, but Burke comes up with a gun. That presumably was to find
an explanation how Paradiso could get Joan Webster on his boat. It
also provided another instrument to account for splinters in the event
they turned out to be metal as the x rays indicated.
Burke also claims Charlene Bullerwell was the source where to find the
boat. Bullerwell wasn't located until 10-3-1984, a week after the
boat was recovered. She testified in the pretrial she was pressured
by the FBI and refused to testify at trial. She was located from a
photo seized on 4-25-1983 by Tr Palombo and Sgt Tammaro. Statements
confirm Palombo met with SA Broce and provided evidence.
The Bond statement was false. It was fed to him. That leaves 3 big
problems with the statement submitted:
1. Authorities continued to promote the boat theory and diverting the
investigation.
2. Authorities abandoned the MO they were developing for the correct
manner of Joan's death. Bond pointed to the correct location on his
head and described a large amount of blood.
3. Burke and Palombo both misrepresented their own informant's
statement and reversed the order of events.
It is a reasonable to examine the people involved in developing this
scenario and what specific knowledge they had about Joan's death.
