Form W-8BEN is submitted by foreign individuals that receive income in the U.S. The form establishes that the person is a foreign individual and owner of said business. The W-8BEN is called the certificate of foreign status.

Form W-8BEN is used by foreign individuals that receive income from sources in the U.S. Only non-U.S. persons file form W-8BEN, not U.S. persons. As well, the form is only for individuals, entities fill out W-8BEN-E.

Form W-8BEN is sent by the company making payments to the individual. The form should be returned to the company or entity that sent the form W-8BEN, not the IRS. It's also not meant to be filed with a tax return. Typically, the form should be submitted before the first payment is made.

You need to include your foreign tax identifying number (foreign TIN) in your W-8BEN form. Without it, the IRS considers your form incomplete unless you also complete the Explanation of Missing Foreign Tax Identifying Number form (PDF).

Members with a valid W-8BEN form who earned at least $10.00 in interest will receive a Form 1042-S. The IRS does not require any action with this form. It simply tells the IRS how much interest you earned during the year.

This guide defines what IRS form W-8BEN is, its purpose, whether the IRS requires it, when and who should submit it, and to which parties it should be sent. How to fill out the tax form using IRS Instructions for Form W-8BEN is also covered.

W-8BEN is an IRS form used by individual nonresident aliens (NRA) to report information to withholding agents, payers, or FFIs if they are the beneficial owner of an amount from U.S. sources subject to income tax withholding or the NRA account holder at a foreign financial institution (FFI).

Do not send Form W-8BEN to the IRS, and do not file it with a tax return. Instead, you should submit the completed form to the party that requests it. Typically, this is the person or group from whom you received payment. The tax form should be completed before the first payment is made; otherwise, the withholding agent may have to withhold the full 30% that is normally withheld under U.S. tax law.

Form W-8BEN will remain valid for at least three calendar years. A Form W-8BEN expires on the third complete calendar year after it is signed. For example, if you sign a W-8BEN on July 28, 2021, it will expire on December 31, 2025. You need to file a new W-8BEN sooner for changes in circumstances causing information on a submitted W-8 BEN to be incorrect.

Form W-8EXP. As the name of this one suggests (Certificate of Foreign Government or Other Foreign Organization for United States Tax Withholding and Reporting), only foreign governments or other groups use this form to claim a reduction in tax withholding.

Form W-8IMY. The last form on our list (Certificate of Foreign Intermediary, Foreign Flow-Through Entity, or Certain U.S. Branches for United States Tax Withholding and Reporting) is only used by intermediaries, flow-through entities, and certain U.S. branches.

The IRS issued 2016 versions of Form 1042-S, Foreign Person's U.S. Source Income Subject to Withholding, and Form W-8BEN-E, Certificate of Status of Beneficial Owner for United States Tax Withholding and Reporting (Entities), and instructions for each form in April. The revised Form 1042-S requests important new information that was not required on the form for the 2015 reporting year.

In general, a withholding agent1 must file an information return on Form 1042-S to report amounts paid to foreign persons that are reportable under Chapters 3 and 4 of Subtitle A of the Internal Revenue Code.2

Form 1042-S is used to report amounts paid to foreign persons (including persons presumed to be foreign) that are subject to income tax withholding, even if no amount is deducted and withheld from the payment because of a treaty or exception to taxation, or if any amount withheld was repaid to the payee. It is also used to report amounts withheld under Chapter 3 of the Internal Revenue Code. The form also applies to foreign exempt organizations, withholding on "effectively connected income" of partnerships, and to Foreign Investment in Real Property Tax Act (FIRPTA)3 withholding.

The Foreign Account Tax Compliance Act (FATCA)4 established a new reporting and withholding tax regime under Chapter 4 of the Internal Revenue Code. The FATCA regime represents a significant development in the landscape of international tax compliance that aims to prevent efforts by U.S. persons to hide unreported income and assets offshore. Pursuant to Secs. 1471 through 1474,5 it requires withholding agents to withhold tax on certain payments to a foreign financial institution (FFI) unless the FFI has entered into an agreement with the United States to, among other things, report certain information with respect to U.S. accounts. In addition, it imposes withholding, documentation, and reporting requirements on withholding agents with respect to certain payments made to certain nonfinancial foreign entities.

The specific W-8 form used by the international vendor depends on the type of payment and the status of the business. A valid W-8 series form must be provided to the withholding agent prior to receiving a payment.

The revised instructions for how nonreporting intergovernmental agreement (IGA) FFIs should properly document themselves on the form and certify their status are intended to coordinate qualification for that status under the IGA with the Chapter 4 regulations. An FFI that satisfies the requirements of both a nonreporting IGA FFI under the IGA and a deemed-compliant FFI status under the regulations should certify as a nonreporting IGA FFI, unless the entity meets the requirements for owner-documented FFI status for payments associated with the form, in which case it should certify that status under the regulations only, by completing Part X of Form W-8BEN-E.

10A payee may certify under penalties of perjury that because of the payee's foreign status, payments to the payee are exempt from information reporting and thus backup withholding. See Rev. Proc. 83-89.

Hello all. Even after reading through dozens of other forum posts about this W-8BEN tax form I'm still confused. I live in Bermuda so I literallly have no experience whats so ever in regards to filling out tax forms. Filing for taxes is not necessary here. I see under the Tax information section of my account in regards to the W-8BEN form I can just type my legal name right in Upwork's website and that I am already classified as non US under the Federal Tax Classification. Do I actually need to go outside of the Upwork network to find this form online and fill it out? Then actually file it with the United States. Or will entering my name right on upwork's tax information page be suffice to get my earnings when I actually have them?

I unterstand what the actual form is, what I am uncertain about is if I actually have to source the blank form on the internet, fill it out then submit it as a document to the United States Tax system.

Do you know what I have to write in my tax information field? this field is required in order to complete my w-8ben form. Do I just have to write my name or register the business itself in my country? I don't get it.

You can list your full name in the Name of Business field, you don`t have to open a company in order to fill out he W8-BEN form. If further help is needed let me know, thank you.

Back in January 2017, The IRS made a few modifications to its Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding and Reporting for Individuals (W-8BEN form). This form is filled out and returned to credit unions by individual nonresident aliens who are the beneficial owners of an amount subject to withholding. Sources of income that non-resident members may receive from the credit union subject to withholding can be dividends. This is why many credit unions try to obtain a W-8BEN form when a nonresident member opens a share savings account.

The final rule implemented by the IRS requires that credit unions obtain certain information from individual nonresident aliens such as their foreign tax identifying number (TIN) and date of birth on a withholding certificate.
