See posting for Derry 2016 re: how interpretation of election law by the Deputy SoS, supported by the the AG , inexplicably changed from “Moderators are given significant authority to determine what procedures at their polling places are necessary to ensure an accurate count" to “they have no statutory authority" to do so.
In the Derry 2016 posting, I neglected to include the Derry moderator’s response to the AG in Oct. 2016 re: the alleged unauthorized recount in Sept. 2016, where she explained what she considered her responsibility as moderator and differed with his interpretation of “recount.” She receive no response. See TillResponseAG 16 attached.
In 2020, citizens have reported two additional violations of election law to the attorney general’s office re: the action taken against the Derry moderator in 2016.
1, See attached Scanlan Letter 9/12/16. and Reporting Violation of RSA 641:31 by David Scanlan, includes response from Assistant AG Nicholas Chong Yen.
2. See attached SOS & AG letter 102016, Still shots from camera final (removed because it made this too long to post!) and Reporting Violation of RSA 659:77, III, NHCONST. pt. 2, art. 69 by David Scanlan, Bill Gardner and violation of AG Joseph Foster’s duty of care. This includes the Oct. 27, 2016 reported violation of RSA 666:3 by the Secretary of State. No response from the AG in 2016 and no action taken by AG on most recent violation of law as of 1/1/21.
