But I was thinking about how the massacre would play out in today's
society. Tom Lions was known to be the one that called them all back.
He, supposedly, scalped Jacob's wife and was recognized. So he would
have been arrested and would have probably given up the names of the
other Indians and the French.
Everyone would have been rounded up and arrested, then the
investigations would have begun. I would imagine that there would be
strong evidence, based on getting the top CSI experts involved.
Examining tomahawk wounds, musket powder burns, tying the recovered
scalp back to the victim, forensic mocasin casts and eyewitness
reports, there would probably be overwhelming evidence. Plus it would
be all over the news.
Based on how long it has taken the trial of the September 11th
suspects to gel, it could take years to reach the courts but the
seemingly ample, strong evidence would probably convict the suspects
and incarcerate them for life or condemn them to death row.
Then the civil lawsuits could begin. What would we have here? Loss of
productive lives, injury, kidnapping, possible crossing state lines to
avoid prosecution, invoking the RICO Act on the smoke signals, ethnic
cleansing, sexual harassment (the wife and kids were tortured and
killed), permanent stress damage . . . there could be a million things
the lawyers could dream up. Of course, the estates and/or earning
powers of the incarcerated warriors (from books or movie rights) would
not probably add up to satisfy the immense damage that had been
inflicted upon the Hochstetler family, so the lawyers would probably
go right to the Indian Nation. If the tribe(s) still exist, they might
possibly have gambling casinos, bars or other assets that could be
attacked and attached.
Plus there's the liability of the state and federal government, which
didn't seem to do much to prevent this type of thing (the Hochstetlers
were absolutely NOT the only massacre in the area).
Insurance would have to be involved too. They would probably have
rebuilt the log home pretty quickly but maybe not since Jacob would
have been gone, disappeared, for a few months or years. So maybe John
would have moved to declare him deceased, who knows. But that would
have been probably been going on in the background.
Holy Cow, what a mess it would be with the journalists, lawyers,
adjusters and the parties on both sides. But I guess that's the
advantage we have of being so far advanced in the 270 years since the
massacre, right?
