State pushes for three year prison term for molesters

The State wants harsher punishment for those found guilty of molesting
women, and has filed an affidavit in the Bombay High Court seeking
amendment to the relevant sections of the Indian Penal Code.

Section 354 of the IPC, which is applied for “assault or criminal
force against the victim with an intent to outrage her modesty”,
carries imprisonment of up to two years. Section 509, applied for
“word, gesture or an act intended to insult the victim's modesty”,
carries imprisonment up to one year. In an affidavit filed by Deputy
Secretary (Home) S G Sonawane, the State wants the jail term increased
by a year in both the sections.

Hearing a suo-moto PIL, the division bench of Chief Justice Mohit Shah
and Justice Ranjana Desai had last week asked the State, if they had
any plans to amend the provision related to molestation, on the lines
of States such as Orissa and Madhya Pradesh. The affidavit filed by
State was in response to that query.
