As per DoP&T instructions, inter-se seniority of DR-PR is delinked with vacancy and is dependent upon year of availability. The relevant instructions are attached. You may get a few representations prepared based upon text given below and send to Director(Staff).

Please also be aware that the actual year of availability in your case is 11-12 (wrt your joining date in July 2011.) However, I have prepared the following text to highlight that the date of UPSC recommendation should be taken as basis for determining year of availability, which really may not be true, but take a chance.

Majority of PR officers in this list are going to retire in next 10 years and therefore are not likely to affect your promotion for JAG. However, few others will remain.

It is found that large number of promote officers who have been promoted to JTS level in December 2011 are placed above the ITS 2010 batch officers.

In this connection, your attention is drawn to DoP&T instructions on seniority under the heading: “RELATIVE SENIORITY OF DIRECT RECRUITS AND PROMOTEES “, wherein it is clearly stated that the seniority of direct recruits and promotees is delinked from the vacancy/year of vacancy, and the seniority / inter se seniority of direct recruits and promotees in a particular year is fixed with reference to the availability of the candidates /officers after completion of all pre-appointment formalities and rotation of quota is applicable only among the available direct recruits and promotees. It is also stated that in respect of Direct Recruits recruited through interviews conducted by UPSC or any other authorities, the date of completion of selection process shall be the date of Commission’s letters containing their recommendation.

In case of ITS 2010 batch, to which I belong, the UPSC recommendations were communicated on November 2011. Accordingly, the rotation of vacancies between DRs and PRs is to be carried out starting with DR ITS 2010 officer and 1:1 fixation is to be done between ITS 2010 officers and promote JTS officers who have been promoted on 30.12.11.

It is also requested that the date of entry in Department, year of recruitment as JTO, date of promotion to AD level and vacancy year for promotion to JTS in respect of all PR officers may be included in the seniority list, so as to correctly evaluate their seniority positions.

I therefore request you to kindly make necessary corrections in the inter-se seniority list.
