It is not about the code but about the authorship and legal
consequences that can arise from an unclear situation about the
uncertainty about copyleft of the actual "official" busybox codebase

Moreover, up to a certain date we have a reasonable certainty about
who wrote the busybox code, after that date such an account should be
considered apocryphal. This means that before certain data, the legal
burden to prove that authorship was already broken is on the shoulders
of those who want to attack the user-base and they are going to win a
paramount asset of untested patches. After a certain date, the legal
burden is on the shoulders of those who are defending their right to
use such software.
