Legal Notice for Allotment of Additional Departments in SLA license issued by Authority.

Dear All

After issuing  circular dt.4th Feb by IRDAI regarding long pending demand of IIISLA of allotment of Additional Departments in S&LA license issued by Authority , many SLAs having  categorization letter of 2001 and having more than three deptts have applied for additional department as per the categorization letter dt. 2001 ,and their applications got rejected quoting the reason that they don't fulfill the educational criteria laid down in regulation 2015 section 27 schedule 1 , which was challenged in hon.Aurangabad HC and matter was fought for more than three years in which IRDAI submitted various 

W S But didn't followed it subsequently ,Hence a legal notice has been issued  to the IRDAI Chairman (copy enclosed) in which it is mentioned that if WS not followed s contempt of court will be initiated against Regulator.

I think this will solve the issue of additional departments for diploma holders or not complying with qualifications criteria of Regulation 2015.

This legal notice would seems not fulfil the requirement of those Surveyors who were categorised in 1-2 deptt.

Since content in notice shows to alott all departments to all Diploma holders of those alotted 5 deptt. in categorisation letter.

I (on behalf of all IIISLA Members) sent mail to IRDA & Council members  to convince IRDA about the issues facing of those who were categorised in 1-2 deptts.

Because those Surveyors  (who were categorised in 1-2 deptts.) are facing badly (comparing to those already working atleast in 3 deptts) for their survival in present scenario of NSL & unethical survey practice by Pvt. players.

There is base of Notice/circular published by IRDA in 5 March 2003. many members were communicated with IRDA throgh post at that time but IRDA does not do exercise  as to do 

in every 3 years as  as per guidelines specified in Regulation 2000.

Please see Point no.2 in Notice published by IRDA in 5 March 2003:

Point 2 : Those licenced and categorised Surveyors who were categorised for less than three departments and want to be categorised for additional

department not exceeding three departments would be categorised for or C Category in that additional department provided a) he has undergone the training for that department as on 31st March 2003 b)he submit an affidavit duly signed by him and the trainer Surveyor and notarised.....& so on...

 As we are standing members of IIISLA,hence we are expecting from our institute to work for those also who are stuckked in 1-2 deptts. since last 20 years.

Dear Nancy

In this matter Regulation 2015 was challenged and relief sought  in the WP is to correct / amend the regulation which was regarding application of educational qualification creteria in regulation 2015 which is to be applied prospectively and not retrospectively , Hence relief will be granted to all similarly affected members.

Mr. Secretary you have spend more than 50 lakh of members for your advertisement and your personal benefits in the name of court case.
No relief to general members from your Aurangabad Court Case.
Only Three individual members got benefits against expenses of huge amount ie. 50Lack (Half Crore)
Now  on behalf of general members of IIISLA , I offer you to put WP of Aurangabad on common forum, if you have courage .

If raising the voice against wrong doing of an individual and as secretary is under indiscipline then you are advised to take appropriate action against me , suspend me or  permanent remove me from the register of membership of IIISLA but I will expose all wrong doers.

But Mr. Rahul

1- Is it not true that you have collected Rs.5000.00 and from from the all 103 petitioners/Surveyors(Approx 6 lack)  of Aurangabad court case ??and you have not spend/contribute single paisa in said case because you are not in list of petitioner. is it true ??
2- You spend / misuse IIISLA (members ) money worth Approx 44 lack (Total approx half crore) in Aurangabad Court Case ??
3- Is it not true that only 3(Three) members got benefited(Interim order) @ cost of Rs.50 lack ?? I am ready to put evidence before members.
4- You have not shared Writ Petition (WP) with any petitioner of Aurangabad Case ??
5- The case was not discussed with any petitioner other then your secret partner Mr. S.B.Nalluri and his close relative ??
6-Even "MISA" oppose your action at that time ??
Now you are secretary of IIISLA and duty bound to put the "Writ Petition" of Aurangabad before members or on IIISLA website for reference and transparency of Members.

Indeed is very correct step and send a legal notice to Chairman IRDAI with regard to contempt of court against the submission stating that STATUS QUO shall be followed and accept the empanelment made in 2001 based on survey work done prior to previous years. 

Chairman IRDAI should immediately honor their commitment given to Aurangabad High Court accepting 2001 Empanelment letter with departments alloted.

Who are you to certify what's wrong doing and tight doings, What you are mentioning as a wrong doing is an attempt to safeguard the members of IIISLA who would have been suffered by the regulation 2015 qualification criteria, yes I was neither sufferer nor petitioner in that W P BUT that doesn't stop me from taking efforts to safeguard the interest of the fellow surveyor brother.

At that time you and your team were sleeping and never bothered to challenge timely regulation 2015 in any H Court and left all the fraternity in dark.

I challenge you if you provide anybody from the petioners have given or deposited with me a single paisa in this matter.

Before writing update your self with facts .

Dear Brothers,

What a dirty politics and back stabbing is going on and on.  Why are we not matured enough to handle any situation?

I do not understand what is going with IIISLA.  If anyone wants additional departments, they can very well write and pass the examination.  From 2001 to 2020 with 20 years experience, they might mastered each and every aspects of those additional departments.  It is really saddening to note that we have spent Rs. 50 Lacs in fighting this case. It is really waste of time and money  instead this amount might have been used for promoting surveyors education and printing periodicals.

We 10 members are in line of filing Public Litigation (PIL) at nearest Aurangabad Highcourt for alotting more than 1-2 deptts as alotted in Categorisation letter.We already urged to IIISLA Council to look for our issues to communicate with IRDA.

 We are searching for various Court judgement of PIL filed previously by some IIISLA members at Madurai,Chennai,Aurangabad court  in addition to IRDA Notice dt. 5March 2003 stated below.

I have already requested IIISLA Council for communication with IRDA for alotting all departments to all Surveyors working before IRDA (i.e. before Year 2000). 

As existing legal notice does not fulfill requirements of those Surveyors have less departments (i.e. 1-2).

Still awaiting for response of mail sent to all CC members.
