Dear Er. Debashis Karmakar and all my respected sisters and brothers in the surveying fraternity,
Your timely wake-up call resonates deeply with every dedicated SLA. Indeed, after the festivities of Holi, Diwali, and more, we must confront the termites eroding our profession: illegal entries by non-qualified personnel, private players' staff, workshop photographers, and loss assessing agencies staffed by unqualified individuals.
Our leadership must shield us, expand our scope (e.g., into property/asset valuation via IBA/RBI collaborations), and adapt our structures to today's realities.
United, we can reclaim jobs, grow SLAs, and flourish. To channel this energy constructively, let's ground our fight in our III SLA Articles of Association (AOA) and IRDAI regulations, which are our strongest weapons:Key AOA Provisions (III SLA AOA, as per latest available amendments)
Eligibility & Membership (Articles 4-6): Only qualified professionals with IRDAI-licensed surveyor certificates can be members/directors. Non-surveyors (e.g., workshop staff) cannot represent agencies in surveys – violations undermine institutional integrity and must be reported for expulsion.
Professional Conduct (Articles 12-15): Mandates ethical practice, prohibiting "illegal entry" by unlicensed reps. Leadership must enforce this to block pvt. players' employees.
Expansion & Governance (Articles 20-25): Allows new wings (e.g., valuation) via General Body amendments, subject to IRDAI/IBA approval. Present leadership can propose AOA updates for livelihood protection – inaction demands accountability.
Critical IRDAI Regulations for Surveyors (IRDAI (Insurance Surveyors and Loss Assessors) Regulations, 2015, as amended up to 2025)
Licensing Exclusivity (Reg. 3 & Schedule I): Only IRDAI-licensed SLAs (with engineering/insurance qualifications) can conduct surveys. "Non-Surveyors" (e.g., agency staff, photographers) are illegal – fines up to ₹1 lakh per violation (Reg. 18).Survey Process Mandates (Reg. 11-13):
Director Surveyor (licensed) must personally attend motor/fire/marine surveys; reps prohibited. Workshops cannot "snatch" jobs via photos – report via IRDAI portal (
irdai.gov.in).
Agency Standards (Reg. 7): Agencies must employ qualified SLAs (min. 50% staff); unqualified "full non-educated" setups are deregistrable.
Leadership can petition IRDAI for stricter audits.Recent Amendments (2023-25 Notifications): Enhanced penalties for "illegal entry" (IRDAI/Reg/Gen/2024); push for surveyor-only fields via Ministry (MoF/IRDAI). No expansion without compliance.
Brothers and sisters, our AOA and IRDAI are shields – but we must wield them!
Present leadership: Counter these foes or prepare for rigorous, Ministry-connected liasion. Let's convene virtually (via III SLA portal) post-Holi to: File collective IRDAI complaints on violations.
Propose AOA amendments for valuation wings, pre insurance risk inspections, spot surveys and indeed Marine Cargo surveys, already snatched away from us. Rally for more SLAs (strength in numbers).
Wash away the dark colors; join hands this bright morning. Together, we'll paint a Holi of prosperity – more jobs, wings, and presence!
In solidarity for our profession's revival,
Sincerely,
K B Manchanda
