We would like to bring to your kind attention on the below points :
· 100% Implementation of Section 64-UM in the insurance act. The same is not being followed at the ground level by most of the insurers.
· In cases where the estimated claim amount is less than INR 50000, the insurers may employ any technical certified person (as instructed by IRDAI) to conduct the survey and may pay the fees accordingly.
· For a better customer experience and a more transparent claims settlement, it is always advised by the IRDAI to engage an intermediary, so that there is no bias in claims settlement. However, employing a person, who is representing the insurer is against the above fundamental and hence we need stricter action here so that a layman is not put to trouble.
· As per Transitory provisions, which states that after a transitory period of three years - that is after Oct 2018, without membership of IIISLA NO PERSON CAN CONDUCT SURVEYS BEYOND NSL (No survey limit) even though he is holding a license issued by IRDAI.
· But sir, again, this rule has deviated many a time, which raises a lot of questions on following the regulations set by IRDAI.
· Few insurers openly admitted in writing that they are violating the law when we tried to record the violations of insurers in order to bring them to the notice of regulatory. Apart from the below mail of M/s Royal Sundaram, I am here with attaching the other two insurers' emails admitting about violating the law of land. Even attached the mail copy shared to your good self earlier about violations of private insurers recorded in the state of Telangana.
In light of the above, we – the Insurance Surveyors and Loss Assessors (IIISLA) forum, humbly seek your kind help and guidance in implementing the above requests 100% at the ground level and any deviations / breaking the rules to be dealt with seriously.
As you are aware, the surveyors are authorized personnel by the IRDAI, and hence, any difficulty faced by us, we will approach the governing body for a resolution and thus, allow us to function in a manner that will ensure the insurance industry in India is respected by the common public.
We all – the IRDAI, Insurers, IIISLA strive to achieve one common goal – Customer satisfaction. Hence, every insured in this country should have a transparent claim settlement process, for which the involvement of an intermediary like IIISLA is most suggested.
