Dear Sir,
This refer to your above circular where in
Authority has pointed about
delays in issuing renewals due to late submission of the
application. The
Authority under the guidelines have stated that one should
apply for the renewal,
at least 30 days in advance. This obviously imply that
processing time is 30
days. Though the authority give opening to the portal, 90
days in advance, but
looking at the guidelines 30 days should be the processing
time.
I am at pain to write that that authority needs
more investigation
into the real problem of surveyors seeking renewals. The
reasoning expressed by the authority
would have been acceptable had the delays been upto the
extent of delays in
submission of application. But looking at ground levels,
license renewals are
pending for months together only to meet one clarification
or the other which
are either not given in guidelines and are invariably
demanded in piece meal.
I have been closely working for licensing
renewals of my colleagues
through on line portal and trying not only to help the
colleagues but I also
intended that I can assist the authority staff to speedily
expedite the license
renewals and bring some relief to surveyors and also to
Authority staff. I very
humbly submit to Authority to please take a note that
license renewal is a very sensitive issue directly related
to
bread and butter of surveyors and delays in it is very
punishing to them.
In
order to once again apprise the Authority, I bring following
facts, to which I
draw your kind attention-
1.
The guidelines for working on portal are not
updated as per regulation 2015 & 2017 and Applicant is
not able to file
application in one go. Repeated clarification are demanded
which delays the
process of renewal.
One example that
portal only asks for IIISLA membership certificate. But
later clarification is
called to submit the IIISLA Subscription receipt. This
itself delays by 2-3
weeks in processing, because staff’s first clarification
come for processing
only after 15 days and that too when hard copies of the
documents are received
by them
I have many cases
in records that hard copies received by Surveyor department
are not properly
managed and this linking with on line data delays the
processing. I also have
records where applicant have sent hard
copies and these are lost in surveyor department. Applicant
keeps writing the
department without any reply. Phone calls are never ever
picked. Frustrated
member is forced to make personal visits when he is verbally
asked to resubmit
the hard copies and some time surveyor staff even demand
fresh submission of on line application.
This is one of the
main reason of delays.
SUGGESTION: I very humbly, request
that guidelines may
please be updated for all requirement as per regulation 2015
and 2017 and list
of documents is curtailed so that documents which are sent
in last renewal are
not demanded again and again. Submission of hard copies
should also be reviewed judiciously as the very purpose of
on line application is defeated if one has
to deal with hard copies again and again.
Present practice
is that department after 15 days of on line application
issues a clarification
and these are known to them not complied because of no
mention in guidelines. Once
the applicant complies to the clarification, then the
application is
scrutinised only after another 15 days and meanwhile the
process is already
more than 1 month delayed. Scrutiny of documents should be
done without waiting for hard copies and shortcoming if any
or clarification should be made withing one week.

It is also observed that staff some time seeks
such clarification which are not clear to them also.
For example,
Authority had issued previous licenses in which some
surveyors gave their
business name and stated to be sole proprietor of the named
firm. Surveyor
Department demands a registration of the firm. If I am a
proprietor of a firm,
I register the firm only if my business require so. Even in
Income Tax, I do
not need a separate PAN number. My individual PAN number is
good enough for my proprietary
firm also. Yes firm may have to be registered in some
department according to
my business like GST, etc. In case of survey profession, I
do not need any such
registration except that in bank I have to give an affidavit
of being
proprietor. If I am not under the limit of GST even then I
do not register the
firm in GST and keep working in the name of firm. In fact
the proprietary firm
is considered to be business name of an individual.
But Surveyor Department
keep on demanding the registration, without giving any
specific clarification.
There is no such mention in Guidelines also. There are
innumerable cases where
the renewals are withheld for this clarification only.
There are similar
clarification which keep on going and renewals are delayed
because of no
clarity in Guidelines.
3.
I had submitted to the authority earlier also
that portal is not user friendly. Invariably it is observed
that applicant’s ID
is blocked and one has to seek help of department to get it
unblocked. Delhi
office has only one person namely Mr. Ajit who takes care of
this portal/ID problem.
In his absence for any reason, applicant keep suffering of
delay in the
application submission. There are no replies from the bap,
or any mails to
Delhi office for unblocking the ID.
I have also
observed that data submitted by the members in past vanish
from the portal and
department starts demanding documents submitted in previous
renewal also. This
again delays the renewals.
I request that
Authority make an investigation that is it some technical
problem and not the
man made mischief like hacking or internal Data theft.
4.
Authority is demanding Form 12 in which she
wants to declare the work done by them every year. The
portal does not accept
every year and this is filed only on renewal.
With due regards
to Authority there is no checking of the same that this
declaration is even
correct or not. Unless and otherwise there is sanctity of
such declaration, and
reasoning to such documentations, any one feel that this
amount to harassment.
In lighter mode I need not give so many documents to obtain
a license to possess
a weapon as much Authority is demanding me for surveyor
license and that too on
renewal.
SUGGESTION: In this regard also I made
a suggestion in
past, that now under prevailing insurance Act 2015, and
regulation made there
in, a person can be surveyor only if he possesses a license
and is also a member
of IIISLA. Similarly insurance company is also suppose to
utilise the a
surveyor who complies the above condition. But on ground it
is observed that
there are violation to this by many individuals, corporate
surveyors and even
insurance companies. With due regards to Authority, she is
not monitoring this
compliance of law or have not set any system to monitor this
compliance.
I propose that in
present time of digitization, a limited linkage of IRDAI
portal, IIISLA portal
and all insurance company’s portal can be done so that
IRDAI not only is able
to monitor the compliance of law and regulation, but also
have ready data of
surveyor which is being asked in FORM 12. IIISLA membership
shall also be
verified through portal as verification in renewal rather
than seeking
clarification. All the more IIISLA membership is not merely
required on
renewal, but all the time. With linkage of IIISLA portal,
even insurance
company shall not depute any surveyor unless portal confirms
that surveyor is
member in good standing.
IN THIS REGARD I HAD A DISCUSSION WITH it
EXPERTS INCLUDING L & T WHO ARE PROVIDING SERVICE FOR
IRDAI PORTAL, AND THEY HAVE CONFIRMED THAT
THEY CAN DO IT IN 2 MONTHS IF SO DESIRED. HOWEVER THIS IS A
POLICY MATTER AND
AUTHORITY HAVE TO DECIDE. I, ON BEHALF OF ALL SURVEYORS, AND
ALSO AS A CITIZEN
OF INDIA REQUEST AUTHORITY THROUGH YOU THAT DECISION IN THIS
REGARD MAY BE
TAKEN WHICH WILL ENSURE TRUE ENFORCEMENT OF LAW AND
FACILITATE ALL STAKE
HOLDERS OF GENERAL INSURANCE. THIS SHALL ALSO REDUCE LOT OF
DOCUMENTATION AND
SHALL CRATE MEANINGFUL DATA AND MONITORING OF
LAW/REGULATIONS.
I SINCERELY HOPE AND REQUEST THE AUTHROTIY
THROUGH YOU THAT LICENSING AND LICENSING RENEWAL REQUIRE
IMMEDIATE AND
DEDICATED ATTENTION TILL PROBLEM SOLVED.
I ALSO MAKE ANOTHER REQUEST THAT DELHI STAFF
MAY
PLEASE BE DIRECTED THAT INSTEAD OF MAKING SURVEYORS FORCE TO
VISIT DELHI OFFICE
IN FOLLOW UP OF RENEWALS, SOME VOLUNTEERING SURVEYORS MAY BE
GIVEN OPPORTUNITY
TO INTERACT AND ASSIST LICENSING DEPARTMENT FOR
REQUIREMENT OF INDIVIDUAL APPLICANTS SO THAT
RENEWALIS ARE TIMELY EXPEDITED. I VOLUNTEER MYSELF AND SEEK
YOUR CO OPERATION
IN ORDER TO HELP MY COLLEAGUES AND ALSO ASSIST LICENSING
DEPARTMENT.
