Sir

One Ashok Leyland Tipper fitted with Hyva tipping mechanism, the tipping ram piston rod got rightward bent while tipping the load at work site , the customer argument is the ram piston got bent when the vehicle got unbalance while tipping and it is an accident claim, please give your opinion, what is the probable cause for this ram piston sidewise bent, whether it is payable  under motor package policy

From the photographs it seems that surface where unloading being carried is uneven. The probable cause may be that the one side tyre might have gone down with the earth. With unbalance there is force working against the rod resulting bending of rod. This is not payable.

Please verify if the hydraulic ram function is severely
obstructed. There are certain instances in which the ram may appear
bent when vehicle is standing on uneven surface but still its
mechanism works smoothly.Or the tipper body might be looking tilted. If
the mechanism is found inoperative or operates with unusual unhealthy
sound there can be element of doubt the ram having bent at either of
the ends. The physical damage to ram can take place only by accident as
it is designed & mounted on the vehicle to take all such forces that
are acting on its normal working condition.Any unwarranted external
force is accidental if is found to be corroborative to the extent of
damage. I personally feel that any SLA should develop fair skill to do
impact analysis ,as an engineer.

02.Use only recommended brands of hydraulic oil.

03.Do not exceed the recommended pay load.
