VIOLATION OF GAZZETTE NOTOFICATION BY CORPORATE SURVEYOR/INDIVIDUAL SURVEYOR

Dear Friends,

This is with reference to various complaints received against  corporate surveyors, we on behalf of IIISLA council has sent notice to them for their clarification & regarding same plz find trailing mail according to which one of them M/s IAR Surveyors P Ltd has sent their reply that they are fully abide all the regulations.

This particular mail is attached for your kind reference &  if any of our members find any violation of new Gazette notification by any corporate surveyor, then plz inform along with some documentary evidence to IIISLA council so that we can put the matter in front  of authorities & take necessary action for the betterment of profession.

Moreover regarding complaints against individual surveyors who are working along with Corporate surveyors  as well as individually ,  I request  all my colleague friends that plz stop violation of the gazette notification otherwise IIISLA council will terminate your membership as per MOA & AOA of IIISLA  & undertaking submitted by you.

I  am hereby enclosing Gazzete Notification for your kind reference so that  later on no one will blame on Council for not giving prior intimation regarding same.

Dear Sir/s, Kindly go through the Gazette Notification regarding Surveyor and Loss Assessor also available on IRDA website dated 26.04.2013.  Please go through point 2(fc) "Surveyor & Loss Assessor", point 4(ii) "Appoint of Surveyors and Loss Assessors", & point no. 7 "Code of Conduct" (i) " Every surveyor and loss assessor shall undertake survey jobs in a company / firm only as an employee / director / partner. Members of IIISLA has sent us various confirm proof that all of you are violating the above norms and are doing contract survey with IAR SURVEYORS AND LOSS ASSESSORS PRIVATE LIMITED.   You are requested to please stop this practice immediately otherwise IIISLA will be forced to cancel your membership and forward this matter to IRDA for further action.      CC: Sh. Ashwani Sethi and Sh. Manu Mehta-- Kindly provide us the list of Directors and details of your employed surveyors alongwith their agreement within 3 days from the receipt of this mail failing which the matter will be taken up with the competent authority of IRDA. Dear Mr Lalit Gupta

Please stop misleading the people. I want to point out certain facts on the issue and you must respond to the same-

1.  Your mail is dated 13-5-2013 and is addressed to Mr Ashwani  Sethi and few more , but which company of corporate surveyors are they representing is not clear. 

2.  Your letter has given 3 days time to recipients demanding details of directors and employees. But neither of the two are responded by Mr Ashwani Sethi. What further action is taken by you or the council of IIISLA in this matter. 

3.  You sent the mail in capacity as a council member, was the issue discussed and accepted in council and if yes why the mail was not sent officially under the signature of Mr Sunil Vora (as Convenor cum head of council) and if council has authorised you for action, why did you not send the mail as IIISLA authorised signatory? All the above you sent the mail copy to Mr Sanjay Surpure, but not all the council members. Even above the mail copy is sent to Mr Ashok Kumar ex- IIISLA secretary, Mr Rakesh Soni ex- VP IIISLA and known old associate of Auto Risk (not known if still working through and in name his relatives) and to IIISLA president which is a known mail address in past of Mr Elango. What is the purpose of marking the copy to these former office bearers. This shows that there is certainly something more being concealed that what is being revealed.

4.  Another important point that comes in mind and I seek you remarks/clarification. At some point of time Mr Ashwani Sethi and Mr Jeevan Agarwal were partners in Autorisk and now they parted off. Mr Arun Kumar ex IIISLA secretary and your very close friend and mentor has joined hands with Mr Jeevan Agarwal and he sits in Auto Risk (Jeevan Agarwal) office in Delhi for fews days in a week. Can you please clarify that this letter is not written only to IAR Surveyors under this business rivalry of the two separated partners and you have obliged your mentor and close associate Mr Arun Kumar and Mr Jeevan Agarwal (I think you have some family relation also, correct me if I am wrong) with your being a council member of IIISLA. If I am right, then is it not the misuse of your being in the IIISLA and does it not demand a disciplinary action against you. 

5.  With a copy of this mail to all the council members, I demand the probe in the matter and reveal all the correspondence in this regard. But if Mr Lalit Gupta has acted of his own without involving the council in this regard, my this mail should be treated as a complaint demanding disciplinary action against culpable

I also want to mention for general members, that the reference that was made in my mail was not with IAR Surveyor, but many other companies also.

Dear Sri Lalit Gupta & All,

In the concerned personalized reply from Manu Mehta and Ashwani
SethiDirectors of IAR Surveyors and Loss Assessors any sought details
or point wise clerifications are not mentioned. You have also sent the
letter on personal basis only.

This appear to be nothing but just eye wash and does not prove any
thing or any serious action in the matter.

The whole existing leadership has failed to solve any of surveyors
basis problems as being detailed hereunder.

1.Increase in survey fees
2.Removing category system & restriction in three depts.
3.In house surveyor problem (Still existing in most odd & shameful way)
4.Contract surveyors (Still existing in most odd & shameful way)

Guptaji, how much impact these efforts can bring when irda itself takes decisions based on recommendations of Corporates? You are very much aware how the recent changes have taken place in irda and with whose influence? If you are serious to emerge as a leader of good standing, first acknowledge the facts as it is, and then unfold your map to the members, they will have a better feeling and would trust your actions and initiatives more. This is just a thought and it is up to you to acknowledge and act up on or rub it off dear.

seems to be stopped / finished and again a new story is started by the
said central council member which too again appear to be on personal
basis.
