I am sharing some my views regarding above subject,-
12. Appointment of Surveyors and Loss Assessors
(1) No person or a firm or a company shall act as a Surveyor and Loss Assessor without being licensed under Regulation 3 or Regulation 4, as the case may be.
(2) Surveyors and Loss Assessors shall be appointed either by insurers or insured to assess loss under a policy of insurance in respect of
(a) Motor insurance – above Rupees fifty thousand
(b) Other than motor insurance – above Rupees one lakh
(3) The above mentioned limit shall be reviewed every three years by the Authority.
As per law insurer & insured both has equal right to appoint a Surveyor for claim loss assessment.
Now question is that:-
For below Rs. 50,000.00 loss, Motor vehicle claim, If insurance company does not appoint a IRDAI Licence Holder Surveyor for below Rs.50,000.00 loss claim,
What should be the base of claim settlement.-----As per my opinion, it should be only as per bill.
Point:- As per law insurer & insured both has equal right to appoint a Surveyor for claim loss assessment. Means both has also equal right for loss assessment for below Rs. 50,000.00 loss claims. Means Insured can take the insurance claim for below Rs. 50,000.00 loss directly after submission of the repair bill (with specific time limit of claim intimation to insurance company via writing)
Because laws has no information regarding necessity of Surveyor / Survey for below Rs. 50,000.00 loss claim.
EOI:- So many unstated EOI Types practises has been running in our fraternity from a very long time. Firstly we should try to minimise id from our inner side.
Requirement of Software for survey reporting:-
As per me, there is no relation in between Survey Report Software & EOI. I am not in favour of any requirement of software from IIISLA side. We all are independent & we have different different pattern of survey reporting. And so many Survey Report Preparing software,s are available in market. I have been also using a Survey Report Preparing Software from 02 years. Anyone can buy it from open market by his choice.
Conclusion:-
We should focus the real problem. As per my opinion, Surveyor & Loss Assessor is very very important for insurance business & for fair insurance claiming. But we should also justify our requirements in our daily practices. We should follow the Surveyor Regulations 2015.
We should demand the views about EOI of insurance companies from all surveyors of India. Then we should conclude the combined opinions.
