Dear Sir;

            We want to bring to your kind attention that, we all surveyors of Jharkhand are facing a regular problem of misbehavior & hostile attitude of Mr. Kamal Singhania & his son Mr, Pullack Singhania (Prop of M/S Toyota Toplink, Ranchi) during survey & assessment of insured claim cases. Due to their ill behavior and hostile attitude,so many of their skilled employees had also left their job there. In lack of skilled employees and management, proper documentation or billing of insured claim cases after repair is not properly prepared. That is the one of the reason of difference inbetween assessed loss and invoice amount,which is observed regularly. Customers are also not satisfied by their work and behavior. The same may also be inquired  independently from your sources.This is affecting the reputation of your organization.

            On 12.07.2013 Mr. Singhania has crossed all the limit by holding up Mr. Deepak Jaiswal (Surveyor/ Loss assessor ) beyond 11.25 P.M(Night) and forcing him to issue a

fresh D.O of amount Rs.5,40,353/-( Five lacs forty thousand three hundred fifty three ) for a claim of vehicle No OD-14-9098, Pol No TIT/91121867, A/C Prem Prakash Sawaria at Top Link Toyota . Where as he had already submitted his report during mid of June, 2013 considering the all consistent damages of the same and D O (Deliver order) of Rs. 4,50,000/- had already been issued on 15.06.2013 by the competent authority of the insurance company.

            On request of IFFICO TOKIO officials ,he visited M/S Toplink Toyota, Ranchi ( i.e. 25 Km away from Ranchi) on 12.07.2013, for necessary discussion about the quantum of the loss under Policy terms condition. On reaching there the assessment was explained to their claim dealing persons but they didn’t agree upon the assessment &were very regid.In the mean time Mr. Singhania came, started using `UN-parliamentary and filthy languages' with threatening and forcing to issue a fresh D.O of full invoice value. He also made captive to  Mr. Jaiswal beyond 11.25 P.M (night) and he was not allowed to.go out and  threatened that if if his desire is not fulfilled then several allegation will be framed against Mr. Jaiswal.   In the mean time his vehicle tyre air pressure was released intentionally by Toyota Toplink staff as per direction of Mr. Singhania . They had also hidden the bag of Mr. Jaiswal containing valuable claimed documents, camera & laptop. 

The matter was informed to competent authority of  IFFICO TOKIO, Kolkata over cell phone .Considering the unavoidable situation .The competent authority of IFFICO TOKIO, Delhi mailed a fresh D.O of Rs. 5,38,000/- at around 11.25 P.M then only Mr. D.K.Jaiswal released from their captive.The isuue of D.O at 11.25 PM  itself is an evidence of this incident. 

         All such action/activity of Mr. Singhania was of criminal nature and it has been condemned by all surveyor of Jharkhand .Further it was decided not to give services to Toyota Toplink, Ranchi .

 

            There is no doubt that such behavior and attitude shown by one of your DEALER M/S Toplink Toyota is going to damage and affect the `REPUTATION' of your organization. Please refer the Trail mail in this regard and with detail action taken by us. Your proper action in this regard is anticipated.

Regarding:      Kidnapping & Torturing by authorized Dealer M/S Toyota Toplink

 

Dear Sir;

            This is with reference to above I am to say that I had been deputed on 05.04.2013 to conduct a survey of vehicle No OD-14-9098, A/C Prem Prakash Sawaria at Top Link Toyota. The assessment had been done by me and D O (Deliver order) of Rs. 4,50,000/- had already been issued on 15.06.2013 by the competent authority of the insurance company.

            On 12.07.2013 I received a telephonic request at about 3.30 P M from claims head, IFFCO Kolkata to discuss about the assessment drawn by me. Then collected all relevant documents from my office and reached W/Shop of M/S Toyota Toplink at about 5.30 P.M. to discuss about this case. The matter was discussed with Mr. Pankaj Jain (CEO of Toyota Toplink) & other staffs dealing claims there. I discussed the matter in details and convinced them that the items/parts which were not found consistent with the cause of loss as stated in claim form & FIR, had not been considered as per policy condition.

            But after that at about 7.30 P M  Kamal Singhania (Prop. Of M/S Toyota Toplink) came to the W/Shop and started shouting on me using filthy language and started putting pressure on me to change the cause of loss and assessment as because the insured was very close to him. He was compelling me to give D O (Deliver order) of total invoice amount of Rs. 5,40,000/- in writing. Then I denied doing the same as because it was not justified & I was not authorized to deliver the same

            Further I replied that it would be better to talk the competent authority of the insurance company for your demand.

            After that he started threatening me that he would not allow me to go out of his campus till he received D.O of full invoice amount. I then contacted Mr. Gautam Dutta , Claims head, Kolkata over his mobile and told all about the situation.

            In between they snatched my bag carrying lap top, camera & some official documents. Further they intentionally released air pressure of my vehicle which was parked inside their campus. Then they called police from Ormanjhi P.S. and tried to frame charges of taking bribe against me. But I told the fact to them and requested them to remain there to protect me till I leave the W/Shop.

            At. About 11.25 P.M. the competent authority of the insurance company from IFFCO Delhi compelled to issue again a new D O of the said claim as demanded by him so that I may be released from there. After that I anyhow managed to come my residence at about 12.30 night.

                                                                                                           

            I suffered with a lot of pain and mental agony in this incidence. So I request you that we should strongly protest against such criminal attitude and blackmailing insurance company by kidnapping me in this incidence.

On going through your mail,the matter was discussed and inquired from differentlevel and had been learnt  that the survey and assessment report was already sent to Insurance Co. long back ,  if there was any dispute on the quantum,the proper representation should had been made with the insurance Co.

It has also come to our notice that when Mr Jaisawal visited to your Work shop at 5.30PM as per 
request  to sort out the claim matter ,Mr Jaisawal was hold-up by you people beyond 11.00 PM of 
12th July,2013 and he was forced to issued a letter as per Invoice amount.His bike Tyre air 
pressure was also released by some of your people, for which he had faced another problem in
the night hours while returning to home. This matter was already referred to Co's 

officials at that moment and they have taken a very serious note of this.

Is it not a fact that he was released by you people only after 11.15 PM ,i.e. after receiving D.O

from the Co? Such act are violation and taking law in hand.

        
More over with reference to Mr Jaisawal Past past records, he is working with his sincere service with full honesty and such  allegations put upon him are totally baseless, hence turned down. With such of your act and  behavior we all surveyors of Jharkhand are shocked and  agitated.

If you have got unity,  Make a strike call for ONE DAY, I  will request my Surveyor Brothers at PATNA  and other places of BIHAR to  show the UNITY with RANCHI SURVEYOR (If you all agree for the same and  show wish in this direction),

I strongly condemn the the incident. Surveyors are not a property or bonded slaves of the repairers and the insurers. The insurer may have a tie up business with Toyota that does not allow the dealers to Tie-up the surveyors. The concerned dealer should be boycotted and if the concerned insurer does not co-operate with surveyors they should also be boycotted. 

A year back, we had such an incident with a Honda dealer, we lodged a complaint with the local P.S., reported the incident to the manufacturer, Ministry of Finance, IIISLA Central Council, H.O. of the concerned Insurer & G.I. Council. We got positives response from almost all quarters and within five days the dealer was forced to apologize unconditional and gave an undertaking that such incident would not be repeated in future.

Lets fight back.

First action should be STOP visiting that workshop for any survey work, make sure that not even the Pvt.Co. employee enters there. Discuss with all Insurance companies including private and inform the development. If possible distribute pamphlet among car owners to inform them the situations, so that Insured people also know the facts.

Let us take a decision under IIISLA that all surveyor in pan india basis that we will boycott all Toyota dealer till the concerned dealer and manufacturer openly do not issue apology letter. The concerned surveyor invited by the prop of the Toplink Toyota and finally tortured for more than 8 hours and released him in midnight and as per instruction of the said proprietor the all four tyres of his car been deflected. I personally requests Mr J.P. Singh and other central council member to take up the matter with IRDA for safeguards of the Surveyors and with Kirloskar for such humiliation. Best Regards. Dear all

 

The action of the dealer is highly objectionable & does call for drastic action on the dealer/Insurer by surveyors,Insurers and last but not the least by IRDA after finding the truth.

 

Surveyor Units must act fast on such incidences with not allowing the matter to precipitate as is already done.

 

Even it is learnt from the people talking in field that private companies are acting against the main object of 'utmost good faith' in respect of SLAs for reasons, some times in the name of business promotion & some times in the name of loss minimisation.In doing so all technical notes are grossly ignored by them.

 

I suggest to all SLA friends friends when ever the final report is submitted any interaction with dealer/repairer/insured be enteretained and in respect of completed jobs.

 

We must not get involved in dispute of repairer/Insured after final report is submitted to Insurers.

We are answerable to Insurers only. If the assessment is not subject to policy terms & conditions or whenever we are convinced that there is scope for addendum and when we have to attend call of Insurers to attend discussion with them or if Insured issues legal notice to them.No legal notice from repairer/Insured be accepted by surveyor as for perticular loss SLA is only representative of Insurers and the notice should be passed on to the Insurers only for action from their end once they accept the surveyor's report.Of course SLA must appear in court as witness in any dispute arising in respect of final survey issued by that individual surveyor.Such appearances in court are payable at GIPSA fees schedules.

 

There is no reason to get involved in such matters unless Insurers have any roll and the responsibility of settlement of claim is not responcibility of surveyor.Surveyors job is to assess the loss & get the Insured/repairs nod subject to policy terms & conditions for the assessed loss before submitting report.We must therefore insist copy of Policy schedule before concluding assessment if it is not readily available.And this for simple reason that there are certain terms & conditions which SLA may not know in absence of policy schedule and may assess the loss based on std.terms& condi. of policy.

 

At Kolhapur we SLAs are provided with policy schedules with claim papers.If not we can ask for the same to avoid any ambiguity that may creep in final assessment.

 

Lastly I request our SLA friends that when we do loss assessment we must keep in mind that we stand to 'gain' only if our actions are legal in court of law and never take law in to our hands.We must use law as safety tool if need be in adverse conditions such as this.

It is crucial period for surveyors of Ranchi. What is thinking of generel surveyors of Ranchi. Local chapter should be immediate come forward.

For a strong massage of our unity, immidiately, an emergency meeting  of IIISLA national council members, all the chapter chairman/ sec. of all over India  is highly required in RANCHI.

After this meeting, we may call a boycott of TOYOTA if Toyota corporate management fail to take cation against concern dealer.

We all with you on massage board but it should show on practically also.

We know, IIISLA is not for this purpose but in emergency, it should automatically convert into union.

RANCHI CHALO movement is requirement of this time.

ABHI NAHIN TO KABHI NAHIN.

So that they learn a lesson

Dear Sirs,

A well drafted memorandum type letter should be given to  Kirloskar through Toyota Dealers in Jharkhand and Bihar appealing them to take action against the erring Dealer. This action will work like a warning to other  Toyota Dealers also not to harass any Surveyor.

Read complete incident happened with Mr Deepak kumar at Ranchi. This is a result of power delegate to repairer by an Insurance co. Now only we have to control this situation to Unite of all Surveyor and must be protest to Insurance co also ultimate Insurer is sole responsible behind them when Surveyor is representing particular co. And also advisable to insist to Insurance co to take an legal action to the concerned person

Dear All,

Such problems are not new and have taken place in past too.

In my opinion the such problems with in-house non technical surveyors
and surveyors' own staff / assistants (incl. contract surveyor's
representatives / staff etc) can be dealt only by the very very
strong IIISLA and never at individual levels.

With strong IIISLA no such dealers etc can even dare to speak harshly
to any independent individual surveyors.

However nothing has been done in such problems by the existing weak IIISLA.

So I would request to all for being prepared to cast your valuable
vote to the new people in order to form the strong IIISLA for
strengthening the fraternity of Independent Individual Surveyors.

Dear Friends,

 

So much has been written or shared by several surveyors on different group message boards as to the ill treatment and harassment (some called it torturing) meted out to one of the surveyors by a Kirloskar Toyota dealer in Ranchi.   This is a serious issue and needs to be condemned by all practicing surveyors for it happened to our own brother surveyor.   Some even commented that IIISLA should take up the matter seriously with the Kirloskar Toyota Company at the highest level & some others even blamed IIISLA council members for their inaction.  

 

In this connection I did speak to one of the central council members who is aware of this incident and he rightly & immediately advised East Zone Ex-Chairman, Mr. Sashi Bhushan, to verify and report the facts.   This council member was even prepared to visit Ranchi to address the issue personally.  And to his surprise and dismay the central council member was reported to have been informed that the particular surveyor who is a victim of the incident is not a member of IIISLA.  So how and where does IIISLA fits in here?  This surveyor did not have faith in IIISLA hence did not become a member.  

 

Since this incident happened to a surveyor we all should come to his support as fellow surveyors.  But IIISLA cannot be blamed for the inaction of not coming in support of the surveyor who does not believe in IIISLA and is not a member.   Members to note the actual facts.
