Claim is payable without any doubt

I had carried out one survey of a Concrete mixer way back in the year 2006.  The mixer was mounted on Tata LPK 2516.  The entire facts and circumstances of the claim are being narrated below.

At the time of accident the mixer was carrying 06 cubic meters of concrete which could not be removed from it and eventually got hardened inside.  The cement used in the mixer was quick setting type and got hardened within ten to fifteen minutes.  The normal man-hole of the mixer after accident remained on top position and in view of above a square hole was cut to the mixer to remove the concrete to avoid hardening of concrete inside the mixer.  However, this attempt failed as cement got hardened immediately.  Some portion of the concrete was salvaged.  The engine of the mixer after it got turtled, remained in running condition for some time.  This was evident from the fact that engine oil had leaked on the road and there were internal seizures of engine parts.  The Kirloskar engine used to drive the entire hydraulic system was of HA 494 model bearing serial number 04.1168/0400217 and during survey the complete engine was stuck. Later on all the four liners were checked and readings noted which are produced below and the readings clearly show that all four bores had become oval.

The concrete mixer was found warped and had lost its tubular cylindrical shape. It requires replacement. Some concrete is also hardened inside.  Both the rollers on which mixer's tier is mounted are damaged as they have run out of shape.  Other main items like gear which drives the mixer and hydraulic motor which in turn drives gear and hydraulic pump are kept open as at no time insured has shown any damages to these three items.  Insured insisted that few teeth of gear are damaged.  However, these damages were not brought to the attention of the undersigned.  In view above these damages are right now kept open.  These items shall be allowed subject to insured satisfying undersigned with proof after dismantling.

The name plate details of the concrete mixer are as follows.

Schwing Stetter.
Model number AM 6 SHN.
Serial number CM 1649.

Year 07/2004.

The name plate details of hydraulic motor driven by above hydraulic pump are as follows.

Sauer Danfoss.

Serial number DC 040703903.

The name plate details of gear box which drives concrete mixer and driven by above hydraulic motor are as follows.

Sauer Danfoss.
Model TMG 51.2 NN 102 NN.
Serial number PX 041005535.

The main engine drives hydraulic pump whose details are as follows.

Sauer Danfoss.
Model 328708.
Code SPV2/0/0 - R6Z.
PS 183 - CXX - B1.
Serial number DC 040704204.

The weight of the mixer is 3750 kgs is of mixing spirals shape made up of highly wear-resistant steel.

The cost of new Concrete mixer drum was Rs. 390000.00 and the cost of 2 numbers rollers was Rs. 124902.00

SUMMARY

Once the Concrete is hardened nothing can be done accept to use hydraulic hammers to break the hardened Concrete.  The thickness of the mixer plate is around 2.65 MM and inherently mixer drum loses its ovality.

The prudent decision is to allow new drum by deducting reasonable salvage.
