Dear all,

The policy cover peril " self ignition"

There is an exception under motor policy as under:

"any claim arising out of any contractual liability:"

Motor Insurance Policy:

Motor insurance policies exclude coverage for damages arising from contractual liability.
If the body builder’s actions cause damage (e.g., electrical short-circuiting), the motor insurance policy may not cover it.

New chassis is sent to a body builder workshop for building a new body, there are several considerations related to liability and safety. Let’s break it down:

Contractual Liability:

The body builder and the chassis owner (usually the vehicle manufacturer or dealer) typically have a contractual agreement.
The body builder assumes responsibility for constructing the body according to specifications and safety standards.
If the body builder’s work results in damage due to electrical short-circuiting, they may be liable for the consequences.

Electrical Safety:

The body builder must follow safety guidelines during electrical installations.
Proper insulation, grounding, and secure wiring connections are crucial to prevent short circuits.
Any negligence leading to electrical faults could result in liability.

Fire Safety:

Electrical short circuits can cause fires.
The bodybuilder should take precautions to prevent fires during the installation process
Failure to do so may lead to liability on the body builder if a fire damages the chassis or other components.

If body value is not covered then its loss for assessment is not considered.

Call for quotation, work contract awarded certified copy . Police report , electrical inspector report and fire brigade report and then decide.

In such claims we have to go through the policy. Because many times while taking delivery of vehicle (Chassis With Cabin only) and for registration initial policy is being issued on basis of invoice generated by dealers. And further Chassis is being send to bus body builder. If cost of bus body is not additionally endorsed then cost of bus body is not payable.

The question asked is not correct . Does the policy anywhere say loss and damages in garage is not payable . Let’s be very clear about policy considerations. Claim is payable.
