Friends,
The content of a premises is covered under both fire and burglary policy.

Due to Storm and heavy rains the GI sheet roof was blown away and there was minor damages to the building itself. Some quantity of stock was also damaged .
The insured reached the premises immediately after the storm subsided and removed some stock.

Next day when he again reached the premises, he claims that a burglary had taken place and large quantity of stock is missing.

My query is: Will this loss due to burglary is payable ?
Please note that there was no roof on the premises after the storm and the insured had already seen this. No effort was made by the insured to protect the stock in such a situation.

Kindly advice.

Regards

Brother, I just went through your query which was posted long ago but I could not find any reply to your query so far which forced me to respond.

Standard fire policy with additional allied perils coverage covers the loss to the building, machinery, contents or even FFF (Furniture, fittings and fixtures) provided this is included as the subject matter of insurance policy (stands as covered under the schedule of insurance policy) Now in your case if the building and stocks are covered against the risk of bad weather, windstorm, rain etc. as well as burglary then both the losses stand as covered as the result of event insured against. Windstorm/Rain etc. caused damage to the building and then the burglary occurred.
You have not mentioned whether the premises had a boundary wall which was under lock and key? If so, the stocks were still lying in a protected conditions. Even if it is not, and the stocks were lying in a godown/warehouse with no boundary, the damage to building and eventual loss due to burglary is covered.

Under fire policy however if the fire occurs and during that fire the stocks are lost as the result of burglary/theft even if the risk of theft is covered, the loss is not payable as per the conditions of standard fire policy.

If the broken roof is the way from where the theft took place, the loss is not payable.

However in this case, burglary word is used, which itself denotes forceful entry was made, and in that case, the loss seems to be payable,

As per my knowledge, burglary sections apply only where there is forceful entry. I will recheck myself.
