Laminated windshield glasses are subject to depreciation

 

Before discussing on the subject it is necessary to know the construction of windshield glasses

1.     Tempered/toughened safety glass: It is fabricated by heating preprocessed glass in special furnaces to the softening points and then quenched by a uniform blast of cool air.

     Property:- It shatters in the form of sugar particles, thus causing   

    facial or head injury.

2.     Laminated glass: It is sandwiched construction of two pieces of glass with a clear, strong plastic polyvinyl butyral inter layer. 

     Property:- Laminated windshield glass does not shatter on impact.

 

Section 100 of Central Motor Vehicles Rules, 1989 describe about Safety glass which says `The glass of windscreens and the window of every motor vehicle shall be of safety glass’

 

(i)                “Safety glass” means glass so manufactured or treated that if fractured, it does not fly or break into fragments capable of causing severe cuts;

(ii)             Any windscreen or window at the front of the vehicle, the inner surface of which is at angle extending to thirty degrees to the longitudinal axis of the vehicle shall be deemed to face to the front.

 

Explanation.- For purpose of these sub-rules laminated safety glass’ shall mean two or more pieces of glass held together by an intervening layer or layers of plastic material. The laminated safets glass will crack and break under sufficient impact but the pieces of the glass tend to adhere to the plastic material and do not fly, and if hole is produced, the edges would be less jagged than they would be in the case of an ordinary glass.

 

The glass of the front wind screen of every motor vehicle other than agricultural tractors manufactured after three years from the coming into force the Central Motor Vehicles (Amendment) Rules, 1993 shall be made of laminated safety glass.

 

Section I of motor policy defines rate of depreciation on parts which reads as under:

 

Subject to a deduction for depreciation at the rates mentioned below in respect of parts replaced.

1.     For all rubber nylon plastic parts tyre battery and air bags 50%

2.     For fibre glass components 30%

3.     For all parts made of glass Nil.

4.     Rate of depreciation for all other parts including wooden parts will be as per the following schedule

 ALL OTHER PARTS : All those parts which neither comes under the category of rubber, nor fibre or glass comes under all other parts.

 

Accordingly all those mixed constituent components like radiator with plastic tank and metallic core, motorized head lights, rear view mirror, sensors, ECM, wiring harness,  laminated glass (construction of two pieces of glass with a clear, strong plastic polyvinyl butyral inter layer) comes under all other parts

 

OPINION: All laminated windshield glasses comes under all other parts and are subject to depreciation as per age of vehicle.

Except the MOU Policies - we bifurcate & adjust the items of composite material construction in M/R/G.
Can this be followed.

On this discussions I have a minor deviation, we were neither working on the proper wordings of the policies nor applying justified meaning of the words used in the policies. For example no body knows that when the "Other" word changed in to "Metal" while it has no existence in the policy.
 
I am with opinion that this all made up just to minimize loss by crushing genuine rights of insured's by mis-representing policy meaning to make insurers happy, we definitely succeeded in it but as on today the clients are well aware & are playing their cards with Brokers & Tie up Policies which are handled by professional who knows & can read policy wordings.
 
Still it is right time to re-consider, why we are assessing Head lights in "Rubber" for Normal & for tie up in "Other".

We are assessing the Loss, as per depreciation in the Policy condition. As per policy condition, whatever may be the glass, the glass is subject to NIL depreciation.

I agree wiyh yhe opinion of Mr. Jauhari ,such type. Of products fall in the category of 'Others' and hence subject to Depriciation , as per age.

the assessment is done on the bassis of the policy condition which says glass is subject to NIL depriciation. it does not define the chemistry, property or the way the w/s glass is manufactured.

Dear Sirs,
 
Laminated glasses are the improvised development over the quality of Tempered/Toughened
Safety glasses. Sandwitching the glasses or embedding any intervening layer en-riches the glass to accomplish much more safety. This improved state of glass ie. Laminated Safety Glass has come-up after a developmental journey through several years. The Laminated Safety Glass is still the `glass` but with improved quality and may not be subjected to any depreciation.
 
Likewise, a cloth remains cloth whether it is made out of cotton, synthetic, silk, woolen or blend of any two or more.
