URGENT ADVICE/INSTRUCTION FROM OUR SCP PETITION LAWYERS

 

Dear all,

 

This is the urgent advice and instruction received from the Civil Society's SCP petition lawyers:

 

"While the subject case is sub judice, please do not hold any demonstrations at all – they can be construed as Contempt of Court and also as an attempt to pressurize the court (both are illegal acts)."

UPDATE - FYI:


A 2-member Bench of the SCP, headed by the Honourable CJP, held the first hearing after taking suo moto notice today at 9:30 a.m. sharp.


The spouse of the A.S.Judge, Maheen Zafar, was present - she requested further time to hire a defence lawyer.


The minor girl was not produced in court - the ICT police/administration pleaded ignorance of her whereabouts - she has "disappeared" from the govt. women's shelter.


Our petition was admitted and was clubbed together with the suo moto case hearings.


The two counsels (Adv. Asma Jahangir & J.(r.) Tariq Mahmood) were given time to append additional reference materials, data and information with our petition.


The public was asked to assist the court with any additional information available.


The ICT admin was instructed to ensure the presence of the AC/ICT, Ms. Nisha Ishtiaq at the next hearing.


The CJP ordered that a new Medico-Legal examination be carried out ASAP at PIMS.


Two new claimants of the girl's parentage came forward - their DNA testing was ordered.


The next hearing is on Wednesday, 11 January 2017, at 9:30 a.m. - Courtroom # 1, SCP.

Original CNIC is required for SCP entry.

There are lots of cases which are sub judice like Panama Papers, etc but people are holding demonstrations and courts didn't consider it as contempt of court. I think the suo moto happened only because civil society raised their voice. And we must frequently hold demonstrations/ press conferences to show that this is not the case of few individuals which can be mishandled easily, but the whole civil society is concerned about it and watching it along with media. 
And we are raising voice just not for Tayyba now but for all victims. Tayyaba has a symbolic status now. 
So no harm to conduct demonstrations along case hearings

News arrived that T. has been found and that she is now in police custody, which I hope translate into state protection; we also want to be fair in our analysis and not damage the case.
Technically, in terms of action, even if we all agree that initial pressure from CS mostly through social media prompted the SC to launch a suo moto notice, the SC did its job rather on time and well, right after lower judiciary really messed up. If you read the order and statements from SC it is actually saying what we are saying...sowe must also be logical. 

It therefore seems reasonable to mainatin pressure as we have all agreed through social media and attend 11th January session in SC, see what is the outcome and then organise a press conference followed by a candle vigil to express our solidarity with all children victims of bonded labour, imposed DL and internally trafficked, salute the action of the SC and formulate our advocacy demands to the government to address the issue as the whole on an emergency basis.

It's important to attend the hearing. What is the point of holding a demonstration at this stage? What are we demanding in the demonstration?

Thanks Shazia for raising this issue.

 

The problem is the families of the disappeared bloggers/social media activists are not allowing us to hold demonstrations. Now we know that Salman’s disappearance is a not a one off incident but a very well-coordinated operation. May be, we can hold demonstrations against this operation instead of demanding recovery of one activist, we demand an end to the hounding of these activists. I would like to hear from members on this.

Just to understand one critical aspect of the whole action, here I reproduce an excerpt from my latest piece on the topic. 


سائبر کرائمز قانون کے تحت کاروائی کے حوالے سے ریاستی اداروں میں بھی رسہ کشی جاری ہے ۔ اسلام آباد کے باخبر حلقوں میں کچھ دنوں سے یہ خبریں زیر گردش تھی کہ ایک حساس ادارہ ایف آئی اے کی بجائے سائبر کرائمز بل کے تحت کاروائی کرنے کا اختیار حاصل کرنے کی درپے ھے ۔ حالیہ چھاپوں کے پیچھے بھی اس ادارے کی چھاپ نظر آرہی ہے۔  پیشہ وارانہ رقابت اپنی جگہ مگر قومی سلامتی کے حوالے سے دونوں ادارواں کی سوچ میں فرق ہے ۔ ایک خالصتا سویلین ادارے کی حیثت سے ایف آئی اے کا اپروچ بہت وسیع اور لبرل ہے ۔ اور آئین اور قانون کے دائرے میں رہ کر کام کرنے کا عادی ہے۔ اس وجہ سے ایف آئ اے کی جانب سے گرفتاریوں میں پس و پیش کے پیش نظر ایک حساس ادارے نے ازخود کاروائی کی ہے ۔ قابعن نافذ کرنے والے ادارے کی نسبت کسی اور ادارے کی جانب سے کی گی گرفتاریوں کی قانونی حیثت بھی مشکوک ھوگی ہے ۔ قانونی سقم دور کرنے کیئے مذکورہ ادارہ سرگرم عمل ہے۔ اس ضمن میں وزارت داخلہ سخت دباوُ کا شکار ہے۔
