Legal Brief : E-Waste Management Rules 2016

Colleagues,

The Government of India recently introduced “E-Waste (Management) Rules, 2016” (“Rules”). These Rules supersede the earlier “e-waste management and handling rules of 2011”. The new Rules will take effect from 1st October, 2016.

Siemens, notably, will qualify as a manufacturer, producer and a bulk consumer as defined under the said Rules.

These Rules encompass manufacture, sale, purchase, transfer, collection, storage and processing of electrical and electronic equipment (basically anything dependent on electric current for functioning).

E-waste would include electrical and electronic equipment, whole or in part, discarded as waste by the consumer or bulk consumer as well as rejects from manufacturing, refurbishment and repair processes. What is noteworthy is that the new Rules also include CFL or other lamps containing mercury. Furthermore, the Rules now also include components, consumables, spares and parts of electrical and electronic equipment.

Collection of e-waste is now a producer’s responsibility under Extended Producer Responsibility (“EPR”) and producers can set up collection centres or arrange for a take-back, or both, and have arrangements with authorized dismantlers or recyclers. 

 “EPR is an environmental protection strategy to reach an environmental objective of a decreased total environmental impact of a product, by making the manufacturer of the product responsible for the entire life-cycle of the product and especially for the take-back, recycling and final disposal”

The E-waste Rules in fact set targets: producers’ obligation to take care of e-waste will go up from 30% in the first year, to 70% in the seventh year of implementation of the Rules. Financial penalties are to be levied for any violation of the provisions of these Rules and a manufacturer, producer or importer shall be liable for all damages caused to the environment or to a third party due to improper handling and management of E-waste.
