Hi light source

in case of persons liable to tax (including individuals) whoseaccounts
are not required to be audited the due date of filing of income tax
return is 31st july or earlier every year.

In case you have not filed ur it return before 31st july you can file
it later also (within certain time period). In case there is some tax
due you will have to pay small amount of interest plus you lose our
right to revise the it return. For small cases not much to worry.

In case accounts are required to be aufited under any act then the due
date is on or befor 30th september every year.

no, the date for filing it returns for non audit cases remains 31.07
and it has not been extended

There is no extension of date of filing of return.

my query is
is thr require to file Nil Return in case of individual
in ITR - 1
or he should have taxable income then only he can file return?

no, it is not extended &  the due date of filling of IT return is 31st July. but you can file it with in assessment year i.e.  31st Mar 2010 with minor amt of interest. this is applicable in case on non tax audit cases (i.e. proson or firms having business tournover below 40 lacs)

hi Yogini

Under the income tax act, you are required to file return of income if
your income is above taxable limits. If your income is below taxable
limits but TDS has been deducted from your income (or u have deposited
income tax), you can file ur return to claim refund of income tax.

There are other cases where, in Nil income case, it is necessary to
file income tax return. These cases do not appear to be relevant in ur
case so these are not discussed here.

Usually, for persons deriving income from salaries, interst etc a
person having gross total income below taxable limits it is not
necessary to file Income Tax return.

Generally people like to file their it return even if their income is
nil of below taxable limits so that there is continuity in their
income tax file.

In case u have filed ur return in ITR 1 last year and this year ur
income is nil you may file ur income tax return in ITR 1.

Dear Yogini,

There is no issue if you file income tax return, wen your income is below the taxable criteria which is 1.50 Lac for Male & 1.80 Lacs for females and 1.95 for senior citizens ( above of 65 in age)

But there is no need to file tax return if your income is NIL
