i am presently located at Muscat and is due for going back to India during the current year. I have been here since Nov'05 and has already filed my tax return in 2006 as i have to pay IT for earning in abroad due to non fulfillment of NRI status.
 
my auditor has told me that i can file the tax return for  the years 06-07,07-08 and 08-09 later on as i have no indian income and hold NRI status.
 
please clarify the status as i am likely to become resident shortly
 
i am due for going back to India on official transfer in Sep/ oct'09.

Can someone educate me the requirement of NRI status? Do you have to stay 180 days in continuation or sum total in a financial year?

under Income Tax Act

an individual is said to resident of India in any year if he

a) is in India for a period or periods amounting in all to 182 days or
more or

b) having within four years preceding that year been in India for a
period or periods amounting in all to 365 days or more and is in India
for a period or periods amounting to 60 days or more in tht year.

in some cases the periods are changed (merchant navy and one other
instance) which might not be relevant for a general enquiry.


There might be definitions of NRI is other Acts like RBI or Citizen
ship for which I do not have any knowledge. sorry for that.

Hi Mr Chandershekharan,

Every Bank has a cell relating to compliance of Income Tax matters. I
wld advise u to discuss the matter with the relevant department in ur
bank who will advise u on all issues keeping in view ur specific
circumstances.

Normally, As per the provisions of Income Tax, income is deemed to
accrue or arise in India if the income which falls under the head
salaries is earned in India. To my mind you are not required to file
return (In India) of income of salaries which u have earned outside
India. Please be guided by first para of my reply.
