We are writing to bring to your immediate attention a serious matter concerning the unauthorized transfer of funds by Mr. Thappeta Bharath Kumar Reddy, a resident of Gaddamayapalle Village, Chintakunta, Near Mydukur, Cuddapah District, Andhra Pradesh.

 

Background of the Case:

Mr. S. Vijay (Phone No: 8106449270), a resident of Chittoor, Andhra Pradesh, has complained to Helping Hands Foundation (HHF) regarding the theft of ₹24,000 from his PhonePe account on 13th January 2023 at 3:13 AM.

 

According to Mr. Vijay, his roommate, Mr. Thappeta Bharath Kumar Reddy, allegedly transferred the said amount while he was asleep and subsequently fled the scene.


Mr. Vijay has already filed a cybercrime complaint with the Whitefield Cyber Crime Police Station, Bangalore, and registered a case on the Andhra Pradesh Spandana platform. Despite these efforts, no resolution or compensation has been provided to Mr. Vijay, and the accused have not been held accountable.

All the attachments related to this case have been converted into a single PDF for easy reference and are attached to this email for your perusal. The documents include:

1.    PhonePe Transaction Details showing the unauthorized transfer of ₹24,000.

Legal Provisions:

The actions of Mr. Thappeta Bharath Kumar Reddy fall under the following sections of the Indian Penal Code (IPC) and the Information Technology Act, 2000:

  • Section 378 IPC: Theft
  • Section 420 IPC: Cheating and dishonestly inducing delivery of property
  • Section 66C and 66D of the IT Act, 2000: Identity theft and cheating by personation using a computer resource

 

Request for Action:

We kindly request you to:

1.    Initiate an immediate investigation into the matter.

2.    Take appropriate legal action against Mr. Thappeta Bharath Kumar Reddy.

3.    Ensure that the stolen amount of ₹24,000 is recovered and returned to Mr. Vijay.

4.    Provide regular updates on the progress of the investigation to the Helping Hands Foundation.

Subject: Reminder: Request for Immediate Action in the Case of Unauthorized Funds Transfer by Mr. T. Bharath Kumar Reddy of Chintakunta Village.


This is a reminder regarding our earlier communication dated 15th February 2025, in which we requested immediate action on the unauthorized funds transfer case involving Mr. T. Bharath Kumar Reddy. Despite our repeated efforts, we have not received any response, acknowledgment, or action taken report from your office.


Background of the Case:

  1. Email Dated 15.2.2025:
    • Through our email dated 15th February 2025, we requested immediate action against Mr. T. Bharath Kumar Reddy for the unauthorized transfer of ₹24,000 from Mr. S. Vijay's PhonePe account.
    • All the required evidence, including transaction details, cybercrime complaint acknowledgment, bank statements, and photographs of the accused, were attached in a single PDF for your reference.
    • To ensure proper delivery, a hard copy of the email and its attachments was sent via Registered Post with Acknowledgment on 19th February 2025.
    • The tracking results confirmed that the consignment was received at the SHO, Mydukur office, and the SP office, Kadapa, on 21st February 2025.

 

  1. Previous Communication Dated 30.1.2025:
    • A detailed letter addressed to Mr. T. Bharath Kumar Reddy, dated 30th January 2025, was also sent to your office.
    • This letter was dispatched via Registered Post on 4th February 2025 and was confirmed to have reached the SHO, Mydukur office, on 6th February 2025, as per the tracking results.
    • A copy of this letter was also provided in the email attachment dated 15th February 2025.


Lack of Response:

Despite the above communications and the confirmed delivery of both emails and registered posts, there has been no response, acknowledgment, or action taken report from your office till date. This lack of action is deeply concerning, especially considering the seriousness of the matter.


Legal Provisions:

The actions of Mr. T. Bharath Kumar Reddy fall under the following sections of the Indian Penal Code (IPC) and the Information Technology Act, 2000:

We bring the following facts to your kind notice for necessary action:


  1. HHF Letter Dated 30.1.2025:
    • A detailed letter addressed to Mr. T. Bharath Kumar Reddy was sent under copy to the Station House Officer (SHO), Mydukur Police Station, via Registered Post with Acknowledgement Due on 4.2.2025.
    • The tracking results confirmed that the letter reached its destination on 6.2.2025.

 

  1. Email Dated 15.2.2025:
    • An email was sent to the SHO, Mydukur Police Station, under a copy to your office, on 15.2.2025.
    • To ensure proper delivery, a hard copy of the email and its attachments was sent via Registered Post with Acknowledgment on 19.2.2025.
    • The tracking results confirmed that the consignment was delivered to the SHO, Mydukur, and your office on 21.2.2025.

  2. Email Dated 4.3.2025:
    • A follow-up email was sent to the SHO, Mydukur Police Station, under a copy to your office, on 4.3.2025.
    • A hard copy of the email was sent via Registered Post with Acknowledgment on 5.3.2025.
    • The tracking results confirmed that the consignment was delivered to the SHO, Mydukur, and your office on 7.3.2025.


Lack of Response and Action:

Despite the above communications and the confirmed delivery of both emails and registered posts, there has been no acknowledgment, response, or action taken report from the SHO, Mydukur Police Station. This lack of action is deeply concerning, especially considering the seriousness of the matter.


Provisions:

The actions of Mr. T. Bharath Kumar Reddy fall under the following sections of the Indian Penal Code (IPC) and the Information Technology Act, 2000:

  • Section 378 IPC: Theft
  • Section 154 CrPC – Mandatory registration of FIR in cognizable offenses.
  • Section 420 IPC: Cheating and dishonestly inducing delivery of property
  • Section 66C and 66D of the IT Act, 2000: Identity theft and cheating by personation using a computer resource

    As the SHO, Mydukur Police Station, it is their duty to initiate appropriate action against the accused under these provisions.

    Greetings from our Helping Hands Foundation (HHF)!

    We are writing to seek your guidance regarding the case of unauthorized funds transfer by Mr. T. Bharath Kumar Reddy, which we have been pursuing with the Mydukur Police Station.

    Background of the Case:

    1. Initial Complaint:
      • Mr. S. Vijay lodged a complaint with HHF regarding the unauthorized transfer of ₹24,000 from his PhonePe account on 13th January 2023 by his roommate, Mr. T. Bharath Kumar Reddy, while he was asleep in Bangalore.
      • Mr. Vijay filed a cybercrime complaint with the Whitefield Cyber Crime Police Station, Bangalore, and also registered a case on the Spandana platform.
    2. HHF Communications:
      • HHF sent a detailed letter to Mr. T. Bharath Kumar Reddy on 30th January 2025, with a copy to the SHO, Mydukur Police Station, via Registered Post with Acknowledgement Due. The letter was delivered on 6th February 2025.
      • A follow-up email was sent to the SHO, Mydukur Police Station, on 15th February 2025, with a hard copy sent via Registered Post on 19th February 2025, which was delivered on 21st February 2025.
      • Another reminder email was sent on 4th March 2025, with a hard copy sent via Registered Post on 5th March 2025, which was delivered on 7th March 2025.
    3. Silence from Mydukur Police Station:
      • Despite multiple communications, the Mydukur Police Station remained silent and did not respond to our emails or registered posts.
      • Due to this inaction, we addressed an email dated 13th March 2025 to your office, Superintendent of Police, Kadapa, complaining about the lack of response and action from the Mydukur Police Station.
    4. Response from Mydukur Police Station:
      • On 13th March 2025, after our complaint to your office, the Mydukur Police Station responded through email, stating:
        "It is to inform that the entire incident occurred at Bangalore, and Bangalore police have also initiated action. Hence, you may approach them and get it solved."
      • This response appears to be an attempt to evade their responsibility, especially since Mr. T. Bharath Kumar Reddy has since shifted his residence from Bangalore to his native village, Chintakunta, which falls under the jurisdiction of the Mydukur Police Station.

    Current Situation:

    • Mr. T. Bharath Kumar Reddy is now residing permanently within the jurisdiction of the Mydukur Police Station, and we believe that the local police should take appropriate action to resolve the matter.

    Legal Provisions:

    The actions of Mr. T. Bharath Kumar Reddy fall under the following legal provisions, which can be invoked for suitable punishment:

    1. Indian Penal Code (IPC):
      • Section 378: Theft – The act of dishonestly taking any movable property out of the possession of another person without their consent.
      • Section 420: Cheating and dishonestly inducing delivery of property – This section applies to cases where a person cheats another and dishonestly induces them to deliver any property.
      • Section 403: Dishonest misappropriation of property – This section applies when a person dishonestly misappropriated or converts to their own use any movable property.
    2. Information Technology Act, 2000:
      • Section 66C: Identity theft – This section deals with the punishment for identity theft, including the use of another person’s electronic signature, password, or any other unique identification feature.
      • Section 66D: Cheating by personation using a computer resource – This section applies to cases where a person cheats by pretending to be someone else using a computer or communication device.
    3. Criminal Procedure Code (CrPC):
      • Section 154(1): Zero FIR – This provision allows a police station to register an FIR even if the incident occurred outside its jurisdiction. The FIR can later be transferred to the appropriate police station for investigation.

     

    Request for Further Action:

    We kindly request you to:

    1. Instruct the Mydukur Police Station to consider this case under Zero FIR (as per Section 154(1) of the CrPC) and take necessary action, as the culprit has permanently shifted his residence to Chintakunta Village, which falls under their jurisdiction.
    2. Issue necessary instructions to the SHO, Mydukur Police Station, to initiate appropriate legal action against Mr. T. Bharath Kumar Reddy under the relevant sections of the IPC and IT Act, 2000, as mentioned above.
    3. Provide guidance on the further course of action that HHF should take to ensure that justice is served and the stolen amount is recovered.
