Sub: Redressal of grievances of public at large by Indian Railway
Department relating to Railway Junction, Kotkapura, Distt.
Faridkot(Punjab) and so on throughout the Country.
Respected Sir,
Respectfully, it is submitted as under-
1. That applicant, Naresh Kumar Sehgal is a Press Report-cum-
President, All India Hindu Welfare Committee and Editor-in-chief of
Newspapers, Duniya De Charche, Kotkapura. The applicant is also a
social worker as well as religious active member .The applicant is
resident of Irglia and is son of Shri Bihari Lal Sehgal, resident of
near Govt. Girls School, Kotkapura, Distt. Faridkot (Punjab)- India.
2. That the Railway department of India is a vast department,
covering whole of the country. The railway trains render a great
travelling and transporting facility to the public of India and
foreigners day and night. As a result, every man though he is rich or
poor eagerly waits to avail travelling facility by Indian Rails. Thus,
the applicant, its institutions and even public at large, is proud of
Railway Department.
3. That although there are a number of merits in the functioning
of the Railway Department, yet there are also some demerits and
defects in its functioning at various railway stations in the Country,
which are tried to be explained as under with the hope that the same
will be redressed by the Railway Department and all other concerned
for the sake of public interest:-
(i) Railway junction at Kotkapura-151204.
(a) That at this railway junction, the window for supply of tickets to
the passengers, inquiry window, advance booking window and time table
of the trains, are existing on the platform of the Railway Station.
(b) That the situation being such, every passenger of Kotkapura City
which is a big city having a population of about 1/50,000
inhabitants, who is to catch a train from Kotkapura, has to cross a
wooden bridge of high nature having a distance of about 300 ft from
the plate form. The passenger always has its luggage with
him .Similarly if a passengers comes to the Plate form of Railway at
Kotkapura, from the other side i.e. side of SurgaPuri(Kotkapura), then
first of all, he has to cross railway lines before reaching the ticket
window. On the said crossing lines of Railway, there is no safely
measure at all and sometimes the passengers have to go running to the
Window to buy tickets and as such, there always remain danger to the
lives of the passengers as on the said crossing lines, trains ply
frequently. Sometimes when the passengers reach the ticket window,
they find that their train has already left or the same is coming very
late, which causes great inconvenience and harassment to the
passengers and they feel helpless to sit for a long time on the plate
form waiting for the next coming train and at the same time, the
passengers have to look after their luggages.
That it is admitted fact and reality that at every other
stations in the Country, the Ticket Window, Inquiry Window, detail of
time tables of trains, are located on the main entrance gate of the
Railway Station but at Kotkapura junction the situation is otherwise
and such facilities are not available on the entrance gate of the
railway station.
That the other major problem being faced by the
inhabitants of Kotkapura town etc. is the wooden fly over bridge, is
on some part of railway track i.e. it does not cover all the lines of
rail(railway track).on this account the public at large has to face a
great difficulty to come to the plateform in tine .
(c) At Kotkapura junction, there is only one plateform which is
also very short. When, Punjab Mail (Ferozepur-Bombay), Jaipur-
Amritsar, Jammu Tavi and Ahmdabad etc. reach at Kotkapura, the said
plate form does not cover all the boggies of the trains,
(ii)Similarly, the shed raised on the plateform, covers only 2 boggies
of trains and thus 20 boggies of the train remain beyond the said shed
cover.(iii) That there is no symbol electronic instrument on the
plateform to indicate the status of the coming train and its boggies.
As a result, no passenger is able to know as to where is the specific
boggy of the train such like S1, S2 and so on i.e. Al and B1, which
put them in worry and compels to run hither and thither at the
plateform, causing their fall on the plateform and inflicting of
injuries on their person.
(d) That sometime in a day, one train takes halt at the plateform
and at the same time, some other train reaches the plateform and
that is to be taken on the other line beyond the plateform. The result
is that the passengers who are to board that train, have to cover a
long distance to reach the 2nd training standing across the first
train, at the time both the trains are standing at the junction. Some
times, after the first train leaves the junction, the other train
stands halted beyond the plateform and the passengers have to cross
the railway track of the first train to catch their train. The most
important factor is that some times in the morning time, 3 trains
reach the junction approximately at the same time. The passengers as
such, have to run fastly alongwith luggage to board their respective
trains and in the process, as the other 2 trains are halted beyond the
plateform, the passengers entangled themselves in the railway lines &
stones laid by the side of the railway track and suffer grievous
injuries and a large number of such passangers lost their lives, Such
dreadful events daily happen at the Kotkapura Junction. At the same
time, it is not out of place to mention here that the Kotkapura
Railway junction is a big junction having a fourth line where Mall
train generally remains halted or passing.
That in these circumstances, keeping in view the importance and
business of the Kotkapura junction, there must be 4 plateforms of
considerable length to cover all the boggies of trains at any time so
that every train is halted on a separate plate form and the passengers
are not forced to cross the railway track to board their respective
train and to avoid untoward incidents including deaths of passengers.
(e) That at Kotkapura junction, the Railway has very big and spacious
area, on which at least 10 plate forms can be raised to meet the
requirements of the trains and the passengers to board them. At the
same time, the place of the plateform to be raised in the present
place of Deptt. can cover 2 trains (Mails -Express), lengthwise at one
time.
That on the other handy the vacant place of the railway department
at Railway junction, is being encroached upon by Nagar council,
Kotkapura and other persons of public by placing their Khokhas etc.,
temporarily and permanently , running from Railway Phatak/ crossing
near RamBagh to Railway Phatak crossing over bridge, across the
railway junction Kotkapura. As such, by the side of wall in the place
of the railway department, public has encroached upon .Besides this,
the Nagar Council, Kotkapura did not lag behind and it sold the vacant
site of the Railway Department at Kotkapura for a sum of Rs.30/35
Lacs, about 3-4 years in the shape of shop booths. The said site was
sold to 8/10 persons by the Nagar Council. The Nagar council received
the sale consideration but at the time of registration of sale deeds
of the said site, the sold a property was found to be belonging to the
Department of Railway and as such, no sale deed was got exams
registered. But, despite that , neither the Railway Department nor
the Govt. of India took any action in the said illegal sale of the
land of the Railway Department at Kotkapura junction.
(f) That there is entrance gate of the junction at Kotkapura, opening
towards railway Bazar and on both sides of that entrance, the people
running the business of vegetables and etc., encroached the Railway
area by constructing wooden Khokhas which have not been converted as
pacca one But, still, no action has been taken against that
encroachment either by Railway Department or Govt. of India and
concerned officials it appears that all the officers of the Railway
department are hands in gloves with those encroachers. Earlier, at
Kotkapura junction, there was a short gauge railway track and on that
a train used to run. Between Riwari and Fazilka via Kotkapura. But, in
the past, that railway track has been changed into broad gauge track
upto Fazilka .But it is noteworthy to mention here that the said short
gauge track has been changed from Kotkapura to Fazilka only, when in
place of the changed railway track from KotKapura to Bathinda as is
known to the applicant, no broad gauge railway line has been laid by
the department, which has caused a loss to the public at large as
they lost even the earlier short gauge track from Kotkapura to
Bathinda. To make it more clear, from Kotkapura to Bathinda, the
train is being plied on the already old broad gauge line running
between Ferezepur to Bathinda and on-owards. The result is that freque
trains from Fazilka to Bathinda are also to be put on the said single
broad gauge railway track, further results into late coming of trains
to Kotkapura junction, only one , but
5. That there is/old plateform to be used by the passenger for
catching the train from Kotkapura to Fazilka side. That plate form is
made on lower level and as such, passengers have to face great
difficulty while boarding the trains at that plateform.
6. That the bath room and laterins made meant for ladies and gents
at Railway junction Kotkapura, are very old in nature. Their
condition is dilapidated. Even there is no roof thereon. There is no
proper arrangement of water therein. There is no arrangement of
Sweeping out the same .The rest result is that passengers feel
reluctance in using the said bath rooms and laterins at railway
junction, Kotkapura and they have to bear a great difficulty to be
fresh at the junction at the time of need, particularly when on this
junction, trains of long distance run daily frequently and get a
halt at this junction.
7. That not only this, there is not even basic amenity available at
the railway junction, such as of cold drinking water. No doubt, there
is some arrangement of drinking water at the junction, but that is too
inadequate to meet the requirement of the present passengers from time
to time. That arrangement of water also lacks cleanliness of its place
and water. There is no RO system at the railway junction which is very
necessary in these days when the water of this area is very polluted
and unfit to be drunk.
8. That generally at every railway junction like Kotkapura, there is
provision of Loudspeaker for announcement of the coming and departure
of railway’s rails, but at Kotkapura, there is no such provision and
if it was, that has since been cancelled/stopped for the reasons best
known to the Station Master, Kotkapura . The result is that nobody
knows about the exact arrival or departure of the train at the
junction.
9. That there is no arrangement at all about the entertainment of
passengers who have to pass their time, waiting the trains, in the
shape of TV etc. So far as knowledge of the applicant, there are T.V.
sets etc. fixed on such like junctions which also telecast news from
time to time along with other regional or national programmes for the
facility of the passengers. From the said T.V.s, the railway
department used to display its advertisements by getting the same from
public which further adds to the income of the railway. Moreo1 some
time, the police officials of the area or at the junction display
their important information on the T.Vs. installed at other railway
stations.
10. That the important point for consideration is also that there
remains a great hustle and bustle 24 hours at the railway station,
but there is no proper arrangement of benches etc. at the plate forms.
No doubt, there are some such benches, but their capacity is so
inadequate and meagre that only 50/60 passengers can sit thereon and
most of the passengers have to pass their time by standing at the
railway plate form which also causes a lot of inconvenience to the
passengers and naturally, the passengers have to curse the department
in this respect also. So, such an arrangement should be made so as to
accommodate at least 500/600 passengers by providing suitable and of
good condition benches as the old benches are in broken condition and
some times, the people have to suffer loss to their wearing clothes
as the same while sitting and standing entangle in the broken pieces
of the benches.
11. That at railway junction, Kotkapura, there is a shed of very
small size i.e. if the train halts at the junction, its two
vans(boggies) only comes in front of the said shed whereas its
remaining 22 vans have to be halted beyond the said shed .There are
only 4 fans and 2 electric bulbs fitted in the said shed besides the
Rehri to serve tea etc. to the passengers. The result is that the
other vans of the train have to stay on the line beyond the coverage
of the said shed, causing great inconvenience to the passengers at the
time it is raining or day time to stand there. As stated above, there
is great inadequacy of electric lights at the plate form and the
passengers have to wait and catch the train while moving in acute
darkness as well as to trace out their allotted van a like S1 or 32
as the chart of the vans is not visible to the passengers while
standing on the plate form.
12. That there is no generator arrangement at the railway junction.
Whenever lights is put off during day time, the passenger s pass their
time, but when the light is put off at night time, then in the absence
of generator, there is no arrangement of light at all at the plate
form and as a result at night time, there occurs great darkness at
the plateform, causing great inconvenience since to the passengers and
there always remains fear of pick pocketing and theft of luggage of
the passengers,
13. That there is no affixation of any chart/board at the railway
junction to despite the allotment of van and seat number of the
passenger, which further causes a great inconvenience to the
passengers to trace out the same and in that process, the passengers
have to run hither and thither hitting each other.
14. That there is no IC waiting room at the junction. To As such, if
a passenger who in the train having booking of C coach i.e. A1, A, B1
and 1st class, he has to wait for the train while sitting in the
waiting room at the junction and their entitlement is to sit in a AC
waiting room, but there is no such facility at all at the said
junction which is again a sort of great inconvenience and denial of
basic amenities to the passengers of A.C. coaches.
15. That similarly, there is no waiting room at all for both gents
and ladies for the passengers of sleeper class and all such passengers
have also to sit and wait under the shed of small size at the railway
junction causing suffocation and humiliation to the passengers.
16. That there is no waiting room/journey break room for the
passengers reaching Kotkapura after travelling on a train by covering
distance of about 300/500 K.Ms both at day time and night time.
Needless to say, from Kotkapura, trains of long route such as
for Jammu, Ahemdabad , Delhi, Bombay, Jaipur, Jodhpur etc. halt. In
this context, it is also mentioned here that there is no
journey break room at Kotkapura junction for the passengers who fall
ill while travelling in the train. As such, to cover up this defect,
there should be at least 10 such break journey rooms at Kotkapura
junction.
17. That it is a state of more concern that at the said junction
there is no facility of medical aid at all,
18. At the same time, there is no facility of PCO/STD i.e. Public
Call booths at the Kotkapura junction for use of the passengers and
this facility is must and at least 2 such booths should be provided
here.
19. That also there is no facility of any Mess to provide meals to the
passengers who reach the junction by covering long distance. However,
there is only one small Rehri to supply only Tea to the passengers. As
such, there should be at least 2 good Messes at this junction.
20. That there is also no clock room for the use of passengers to
deposit their luggage at the time of their need for few hours and the
said facility is urgently required as well at the said junction.
21. That there is also no stall of any Newspapers at the junction and
by reaching Kotkapura junction, passengers of long distance feel
deprived of this urgent facility.
22. That there is also no inquiry window at the junction to provide
required information to the passengers about the arrival, departure
etc. of the trains at the junction. There is also no 4 Tatkal window"
to make reservation of seat and also such window to get the ticket
cancelled as these are also main facilities to be provided to the
passengers of the trains. Earlier facility has been knowingly some
private contractors disconnected to eligible persons who fixed their
khokhas by encroaching Railway site.
23. That the railway junction is having railway tracks on both of its
sides and there is a bridge towards its Eastern side. In case of any
unnatural event of incidence of accident or fire at the railway
station, there is no arrangement of any ambulance to remove the
injured persons to any hospital, there is no adequate fire
extinguisher instrument at the railway station to put off the fire if
any such fire takes place at the railway station. Besides such
instruments are 1 or 2 with 2-3 buckets of sand to put off the fire
and these are totally insufficient to control such a situation of fire
at the railway station. Moreover, the fire brigade is not to
reach the plat form of the junction as the platform is divided into 2
parts by making construction of building of the railway station.
Besides this, the tankies to contain water for being used at the time
of fire, have gone outlived and rusted and do not contain water, but
despite that no arrangement otherwise has been made at the junction by
the railway department and such an incident can involve loss of lives
and property of the railway at a high scale. Even, there is no
siren at the junction to be blown at any emergency.
24. That Ferozepur and Bathinda are big railway junctions and in
between Kotkapura junction falls. Long trains halt at Kotkapura
junction and the passengers ease themselves there, causing a lot of
dirtiness there. However, after the departure of such train, the
railway tracks are not cleaned with huge water by the railway
department and as a result, latrine material remains at the railway
track giving a lot of foul smell causing most inconvenience to the
passengers present at the junction to wait some other train. The main
cause of such a state of affairs, is that there is no main water pipe
at the junction and the old one is lying broken there which is of no
use at all. That there is no arrangement of water to supply water for
each of the wagons of the train which is most essential facility to be
made at the junction.
25. That there is no facility of any wheel chair for the use of ailing
persons, handicapped persons and aged persons not able to move and
thus at least 5-8 such chairs are required at the junction to meet
this requirement of the passengers.
26. That there is no Coolie at all at the railway junction what to
talk of any trolly For the use of the passengers to load their luggage
to their wagon and as such, passengers have to face a great
inconvenience to take their luggage to the train a wagon or from the
plate form ta to outside. As such, there should be 10/15 coolies
alongwith trolleys for the use of passengers from time to time.
27. That there is single window for issuance of tickets, he employees
open such a window only a few minutes before the arrival of the train
which results into long queues most of the passengers and of
passengers board the train without• getting tickets which causes great
loss to the railway department. Even, a passenger is unable to buy
plateform ticket in time and it also causes further loss to the
department. As such, there must be one window to issue tickets to the
passengers to board trains, the other for issuance of plateform
tickets to the persons who come with the passengers and a window of
"Tatkal"(Reservation of seats) and the fourth window to cancel the
tickets if any passenger so likes. Besides this; there should be
another window meant for senior citizens military persons and
handicapped passengers. An inquiry window is also must at the railway
junction which is not in existence.
28. That it is an important junction of the railway. A number of
trains carrying cement, fertilizer, iron, tyres, oil and coal,
generally halt at the junction and are downloaded every day .But,
there are only 2 plateforms for such goods train which are of small,
size, each opposite of the railway plateform i.e. one on eastern
side and the other on western side. As and when any train carrying
cement, Khad etc. is downloaded at the plateform, it creates a lot of
pollution causing a lot of inconvenience as the passangers 2 have to
face even the noise of the labourers downloading the train. In fact,
such downloading of the trains should be made on a plateform which
may be sufficiently away from the plate form meant for passengers to
board the trains. Besides this, a lot of racks of the articles are
downloaded from the trains at Kotkapura and to meet that requirements
there should at least be 4 plate forms to down load such, goods
trains , so as trucks/trolleys may come near the plateforms to
carry away the goods/articles like cement, coal,Khad, iron etc. For
this purpose, there is sufficient space of the rail-way towards
Rambagh side.
29. That about 30 years back, there was survey of railway track
between Kotkapura to Moga of distance of about 40 k.m. But, that
survey has not been implemented for the reasons best known to the
department. However, the road Kotkapura to Moga is very busy road.
Passengers between 25000 to 35000 daily travel by buses and cars on
this route besides others cars and trucks. A large number of buses of
private transporters ply on this route and they are earning a lot
causing loss to the Exchequer of Central Govt. It is pertinent to
mention here that if railway track is laid from Kotkapura to Moga, the
expenses of it whatever may be, can be made good by running the
trains on this route within a short period of about 2 years.
It is worth mentioning here that on this route, mostly the buses
owned by Parkash Singh Badal, present Chief Minister of Punjab, ply .
He is a rich person and also having influence in the Central Govt.
offices and that is who are of his party and relations, why he
alongwith other transporters/has prevailed upon the Railway Department
and as such, the a railway department has postponed the survey of
railway track on this route, which was done about 30 years back. The
result is that a great loss is being caused every month to the
Railway department besides the a inconvenience to the passeners of
this route.
It is also mentioned here that the passengers from the side of
Fazilka, Abohar, Malout, Muktsar etc.who are to go to Ludhiana and
Chandigarh, first of all they come to Kotkapura and then to go
further, they adopt the train via Ferozepur or Bathinda to reach
Ludhiana or Chandigarh . It is all due to the fact that there is no
direct route of a train from Kotkapura to Moga .Most of the
passengers i.e. 25000 to 35000 have to board buses to reach Moga,
Ludhiana and Chandigarh via Kotkapaura. Due to thus, besides the
inconvenience being caused to the general public in fare etc., the
railway department has also to suffer a lacs of rupees every month.
Thus, there is most urgency for laying down a track of railway from
Kotkapura to Moga as per survey by the department and a provision for
this should be made in the coming budget of the railway department.
The railway track between Kotkapura to Moga, if raised, will
attract and cover passengers who are to come from Sirsa, Fazilka,
Dabwali, Abohar, Muktsar, Ganga Nagar and to each even to Chandigarh
to visit the Hon'hle High Court and Civil Secretariat, Governor
house and other offices located there for their works as the Capital
of Punjab and Haryana is joint at Chandigarh. On this track, a train
from Chandigarh to Ludhiana, Moga, Kotkapura, Muktsar and Fazilka can
be run for the convenience of general public.
30. That from Kotkapura junction, the following trains in between are
also required to be sanctioned and plied:-
(a) Kotkapura junction to Haridwar
(b) Kotkapura junction to Patiala and Chandigarh. (Already existed but
cancelled )
(c) Kotkapura junction to Hoshiapurpur via
Ferozepur
(d ) Kotkapura junction to Chenai
(e) Kotkapura junction to Delhi direct via Btd. at day time between 10
AM to 4 PM
(f ) Kotkapura junction to Calcutta
That to cover all such stations, the trains which ply from Bathinda
may be extended from Kothpaura. That as stated above, Kotkapura is a
big railway junction and if the abovesaid trains are provided as
mentioned above and all alterations are made in the railway junction
plateform, it will give much facilities to the passengers and great
profit in the railway department, but it is not understood that as to
why this important junction has been ignored and the passengers have
been deprived of necessary and urgent facilities at the junctions.
31. That before parting with this application, it is also prayed that
there is no AC coach with the train "Janta Express" from Ferozepur to
Bombay which causes great inconvenience and difficulty to the
passengers t who want to travel in A.C. coach. As such, with the said
train, there should be at least 5 A.C. coaches to meet the requirement
of the passengers. As such, the submissions made in the above
mentioned paras i.e. paras No.s 1 to 31 are of very urgent nature,
providing facilities to the passengers and profit of crorers of rupees
to the railway department.
32. Hence, it is prayed that direction may be issued to the Railway
department to provide:-
(A) Extension of plate forms at railway junction Kotkapura, i.e. 10 in
numbers,
(B) Window tickets be taken on the first entrance gate of the railway
plate gates on both sides of the Kotakpura city.
(C) A space for parking of vehicle, journey break room(AC and non AC),
waiting rooms for 1st class and general class, both of ladies and
gents separately, latrines bath rooms , supply of good quality water
like of Acquaguard container, Mess, canteens, fruit and book-stalls,
ATM, PCO/STD, Sub Post Office.
(D) Shed covering the plateforms, fans, lights, benches, chairs.
(E) Electronic system to be made at the railway plateform showing the
status of each coach boghi/wagon and as to where Boghi/wagon S1, S.2
and so on AC B1, AC-B2, etc. is halt.
(F) Arrangement of announcement at the plate forms intimating the
passengers as to which of the train is coming and which is the train
is leaving the plateform and also whether any train is coming late and
if so, how much.
(G) T.Vs for entertainment of the passangers and also broadcasting
news etc. at the plateform, 24 hours.
(H) Arrangement for cleaning the railway track after the departure of
trains by pouring water on the track.
(I) Fire extinguishers, water tank, bags containing sand etc. to avoid
any untoward incident of fire etc. at the railway station. Also,
ambulance and alarm system be arranged at the railway station.
(J) 24 hour medical service by the doctors, separately by lady doctor
and gents doctor having a railway dispensary at the railway station.
(K) Widow for 24 hours, working “Tatkal Booking” for making
reservation of seats.
(L) 24 hours inquiry window. Another separate widow from where
passengers can buy plate form tickets and window for cancellation of
tickets.
(M) For supply of water to every coach at the railway station/
plateform as and when any train comes and leaves the plateform, in the
need be.
(N) Coolies, luggage chairs, chairs for the use of handicapped
passengers.
(O) Wooden fly over bridge for the use of passengers coming from the
side of Surgapuri to the plateform Kotkapura Junction.
(P) Formation of New track between Kotkapura-Moga-distance about 40 KM
(Q) New Train running from Kotkapura-Haridwar-Dehradoon,
(R) New Train running from Kotkapura to Chenai (Madrass side)
(S) New Train running from Kotkapura to Ganganagar (Raj)
(T) New train running from Kotkapura to Calcutta, Hawara
(U) New Train running from Kotkapura to NJP (New Jalpaigori) Assam,
Gowahati side.
(V) New Train running from Kotkapura, to Patiala, Ambala, Chandigarh
side.
(W) Provision of 4 A.C. Coach with Janta Express running from Ferozpur
to Mumbai and Mumbai to Ferozepur.
(X) A new train running from Kotkapura-Delhi between 9 AM to 12 AM and
from Delhi to Kotkapura between 12 Noon to 3 AM.
(Y) Encroachment over land (movable and immovable) crores of rupees
belonging to the Railway Department at Kotkapura by making Pacca and
Katcha construction thereon, may be directed to be got removed without
any further loss of time.
Hence, it is prayed that considering this petition as Public
Interest Litigation, all the facilities mentioned in the prayer clause
as well as in the paras of the petition which are not available at all
railway junction Kotkapura which the Indian Railway provide to the
general public/passengers in routine may kindly be provided at the
railway junction Kotkapura Distt. Faridkot Punjab encroachment made
over railway land at Kotkapura be got removed and also by providing a
few new trains from Kotkapura Junction to various other important
cities and formation of new track from Kotkapura to Moga (distance
about 40 Kilometer) at the earliest possible by issuing a suitable
direction to the Indian Railway Department in public interest and
justice be done.
