As you know the referendum on opening out Civil Marriage to lesbian and gay couples is
likely to be held next year around May.
I think the Commission should take a position on this matter of principle, which will be put
to the citizens of Ireland.
The Equality Authority had a long-standing and strong position in favour of civil marriage
and took public positions in favour of equal marriage rights in the media etc during the
debate on the civil partnership legislation.
Arising from the debate on civil partnerships, the report of the Colley Group etc that
recommended opening out marriage to all couples, IHRC commissioned research from
Fergus Ryan and Judy Walsh (2006). IHRC did not take a position on marriage, ostensibly
on the basis that the right to marry for lesbians and gay men had not been established in
international law. There were differences of opinion re this view on that Commission I
understand.
On the Working Group on the merger, I made the case that, in the interests of certainty,
‘emerging’ human rights should be considered by the new body, and this is now included in
the legislation.
There is a general agreement I think that there should be a ‘levelling up’ of rights between
the equality and human rights.
There is a degree of urgency about this matter, so I propose that it be a separate item on
the agenda at our December meeting.
I guess the decision sought could be; ‘that the Commission confirms the policy of the
Equality Authority in supporting opening out civil marriage to lesbian and gay couples and
that such a right be included in the Constitution’. The Executive could then prepare a
succinct policy paper.

and took public positions in favour of equal marriage rights in the media etc during the
debate on the civil partnership legislation.
Arising from the debate on civil partnerships, the report of the Colley Group etc that
recommended opening out marriage to all couples, IHRC commissioned research from
Fergus Ryan and Judy Walsh (2006). IHRC did not take a position on marriage, ostensibly
on the basis that the right to marry for lesbians and gay men had not been established in
international law. There were differences of opinion re this view on that Commission I
understand.
On the Working Group on the merger, I made the case that, in the interests of certainty,
‘emerging’ human rights should be considered by the new body, and this is now included in
the legislation.
There is a general agreement I think that there should be a ‘levelling up’ of rights between
the equality and human rights.
There is a degree of urgency about this matter, so I propose that it be a separate item on
the agenda at our December meeting.
I guess the decision sought could be; ‘that the Commission confirms the policy of the
Equality Authority in supporting opening out civil marriage to lesbian and gay couples and
that such a right be included in the Constitution’. The Executive could then prepare a
succinct policy paper.
