प्रिय साथियों,
अभी हाल ही में उत्तर प्रदेश के अलीगढ़ जिले में किसानों द्वारा भूमि अधिग्रहण के खिलाफ संघर्ष और देश भर में चल रहे अन्य संघर्षों के मद्देनजर केन्द्र सरकार द्वारा भूमि अधिग्रहण अधिनियम 1894 में संशोधन की बात की जा रही है। मौजूदा यूपीए सरकार द्वारा संसद के शीत सत्र में यह संशोधन विधेयक लाने की पूरी तैयारी भी चल रही है। भूमि अधिग्रहण एवं पुनर्वास एवं पुनस्र्थापन दोनों ही मुद्दों पर सालों से चर्चा होती रही है। जबकि विभिन्न सरकारों द्वारा खासकर पुनर्वास के मुद्दे पर तमाम नीतियां लायी गई हैं। अलीगढ़ एवं अन्य जगहों पर किसानों का आंदोलन कोई अकेला मामला नहीं है। अन्यायपूर्ण भूमि अधिग्रहण के खिलाफ देश भर में संघर्ष जोर पकड़ रहा है। जबकि केन्द्र एवं राज्य सरकारों द्वारा बल प्रयोग करके तमाम आंदोलनों को कुचलने के प्रयास किये जाते रहे हैं।
हम पिछले 20 सालों से भूमि अधिग्रहण अधिनियम 1984 के जनविरोधी धाराओं का विरोध करते हुए विभिन्न मंचों के माध्यम से उसे रद्द करने की मांग करते रहे हैं। सन 2007 में संघर्ष के बैनर तले एकजुट हुए जन आंदोलनों के साथ मिलकर हमने भूमि अधिग्रहण विधेयक पर विस्तृत विचार-विमर्श की प्रक्रिया के बाद विधेयक का एक वैकल्पिक मसौदा भी तैयार किया था। इसके अलावा सन 2007 में ही हमने दिल्ली में एक व्यापक विचार-विमर्श की प्रक्रिया भी अपनायी थी। जबकि भूमि अधिग्रहण (संशोधन) विधेयक एवं पुनर्वास एवं पुनस्र्थापन विधेयक को यूपीए सरकार द्वारा सन 2007 के शीत सत्र में एवं सन 2009 में मॉनसून सत्र समाप्त होने के मात्र एक दिन पहले संसद में पेश किया गया था। जबकि, राष्ट्रीय एवं क्षेत्रीय दोनों ही स्तरों पर जन आंदोलनों एवं समूहों से विचार-विमर्श की प्रक्रिया को पूरी तरह नकारते हुए ये विधेयक पेश किये गये हैं। ये विचार-विमर्श सन 2006 में राष्ट्रीय सलाहकार परिषद द्वारा पारित एक ड्राफ्ट के माध्यम से पूरे हुए थे। तब से वह ड्राफ्ट केन्द्रीय कैबिनेट पास लम्बित है। इसके अलावा हाल ही में संसद की स्थायी समिति ने भी भूमि अधिग्रहण विधेयक 1894 एवं पुनर्वास एवं पुनस्र्थापन विधेयक में विभिन्न कमियों को उजागर करते हुए कुछ संशोधन सुझाये हैं। जबकि, इन सबको नजरअंदाज करते हुए एक बार फिर इन विधेयकों को पेश किये जाने का प्रस्ताव है। यदि ये दोनों विधेयक लागू होते हैं तो, देश भर में लाखों लोगों के जीवन, उनकी आजीविका एवं जल, जंगल, जमीन व खनिज जैसी प्राकृतिक संसाधनों पर दूरगामी प्रभाव पड़ेगा।
ऐसी परिस्थिति में, जरूरत इस बात की है कि आजादी के बाद से अब तक देश भर में हुए भूमि अधिग्रहण एवं पुनर्वास पर सरकार द्वारा एक श्वेत पत्र जारी हो और तब तक भावी भूमि अधिग्रहण पर रोक लगाया जाए। साथ ही इतने व्यापक प्रभाव वाले विधयेक को जल्दबाजी में पेश करने के बजाय इस पर विस्तृत विचार-विमर्श की प्रक्रिया अपनायी जानी चाहिए। हमने विभिन्न स्तर पर यह प्रक्रिया शुरू भी कर दी है। इस संदर्भ में हमने आगामी 23 सितंबर 2010 को दिल्ली में एक विस्तृत विचार-विमर्श आयोजित करना तय किया है। इस विचार-विमर्श में विभिन्न जन आंदोलनों के प्रतिनिधियों, संगठनों, विशेषज्ञों एवं कार्यकर्ताओं की उपस्थिति अपेक्षित है। अतः आपसे आग्रह है कि विचार-विमर्श की प्रक्रिया में शामिल होकर प्रस्तावित ‘राष्ट्रीय विकास, विस्थापन एवं पुनर्वास विधेयक’ पर अपने अनुभवों एवं प्रतिक्रियाओं को जोड़े ताकि जन आंदोलनों की ओर से एक विस्तृत मसौदा तैयार किया जा सके।

Greetings !
People's Movements across the country have been struggling for retaining their right over the land they have occupied, resisted attempts at evictions or displacements due to large infrastructure projects, submergence by dams or deprivation / landlessness by any means. The demand for a comprehensive Development, Displacement and Rehabilitation Act has been an ongoing one for close to two decades now. There has been numerous consultations, meetings, dialogues, demonstrations in Delhi and all across the country however, the government has failed to address the genuine concerns in all these years. In the wake of the recent protests by farmers against unjust acquisition of land in Aligarh (Uttar Pradesh) and elsewhere in the country, there has been again a vociferous demand made by different political parties to bring in the Land Acquisition (Amendment) Bill, and Resettlement and Rehabilitation Bill.
However, it needs to be noted that the agitation by farmers in Aligarh and elsewhere in Uttar Pradesh are not isolated incidents. Struggles against unjust land acquisition have been intensifying across the country. The only response of the government has been a brutal suppression of these struggles using its police force. In July this year, the Government of Andhra Pradesh fired at, killing three persons, and lathi-charged hundreds of peaceful protesters in the Sompeta Mandal of Srikakulm district, who were resisting the forcible and unjust acquisition of land for the 2640 MW thermal plant by Nagarjuna Construction Company Ltd. In mid August then private goons of Jindal Steel and Power Ltd. beat-up villagers who were peacefully protesting the forcible acquisition of land, in Tapranga, Raigarh district of Chhattisgarh, by the company for coal mining. There are innumerable instances of such acts of harassment, exploitation, dispossession all across the country.
The Land Acquisition (Amendment) Bill and Resettlement and Rehabilitation Bill were tabled by the UPA government during the winter session of 2007 and just a day before the monsoon session of 2009 ended. Introduced purportedly to strike a balance between the need for land for development and other purposes and protecting the interests of the persons whose lands are statutorily acquired, both the Bills in fact facilitate the handing over the land, rivers, forests, minerals to the big corporations, both public and private, for mining, big dams, thermal, nuclear and other power projects, SEZs, etc., without effectively addressing the fundamental issues that have been raised by the protests that are raging across the country. If enacted, both the Bills will have far reaching impact on the lives on millions of people across the country, their livelihood and access to natural resources—land, water, forests & minerals.
The issues of both Land Acquisition and Resettlement and Rehabilitation have been discussed and debated for several years now. The government has brought forth several policies, especially on the latter issue. However no process of thorough stock taking has yet been initiated by the government. In fact even the most basic information, which is crucial for determining the areas and direction in the laws and policies that need to be formulated and amended, is not available.
Further, these Bills were introduced in complete negation of the consultation with people’s movements and groups at both the national and regional level. These consultations culminated in a draft National Development, Displacement and Rehabilitation Bill which was passed by the National Advisory Council in 2006. Since then the draft remained pending with the Central Cabinet on the excuse that there were questions and barriers to be faced and clarified, before it could get its sanction. Prime Minister Manmohan Singh has announced that the Government would bring these Bills in the Winter Session of the Parliament.
It is in this context, need to demand white paper on all land acquisition and R&R since independence and also moratorium on all land acquisition in the country. While there is also an urgency to renew the efforts by bringing back the focus to the National Advisory Council Draft, improve upon that and work towards facilitating a comprehensive legislation which is basic to Development Planning. It will the base for any developmental projects in the country and help fight the 'Development Terrorism' unleashed by the government and corporations all around.
We do hope you will be able to join us for a National Consultation on September 23rd, Thursday, at Indian Social Institute, Lodi Road, New Delhi with your colleagues in the movements and groups so that we can discuss all these issues in detail and work on a better draft of the Comprehensive Act.
