Permission of medical Board before criminal prosecution

Can a provision be asked for whereby the Medical Board formed as per Jacob Mathew guidelines be asked to specify whether the alleged act of the medical professional is
 
1) Misdemeanor; a minor wrongdoing.
2) Misadventure; harm or death caused by a person accidentally while performing a legal act without negligence or intent to harm.
3) Misconduct; Culpable neglect of duties, unacceptable behaviour
4) Error of judgement; wrong or a bad decision though used reasonable skills and had the necessary training to make decisions consistent with professional standards
5) Negligence ; Omission to take ordinary care resulting in harm / death. 
6) Gross Negligence (Criminal);  accused with a guilty mind (mens rea) has run the risk of doing an act with recklessness and indifference to the consequences which in all likelihood were going to happen.
