Has the SUPREME COURT covered itself with disgrace?

gloating on being SHAMELESS is a PROVEN FACT. Has the Supreme Court
attempted to salvage the Govt from another embarrassing situation?
That Dr Singh has also affirmed that he is SHAMELESS is also a
NO-BRAINER as even if he had an iota of SHAME left in him, he would
have quit long back. Neither is his wife(Gursharan Kaur) any close to
Smt LALITA DEVI(the wife of Shri LAL BAHADUR SHASTRI) who is said to
have "UPBRAIDED" SHASTRIji over PHONE while in Tashkent after he had
signed the Tashkent agreement!
Is the Supreme Court there to deliver and dispense Justice or to save
the Government from embarrassment? - JUST see what the SUPREME COURT
SAID in its JUDGEMENT as an ADVICE to the GENERAL - "MOVE WITH THE
WIND" - What NONSENSE - The learned JUDGE seems to have followed this
in getting promoted to the SUPREME COURT! The SC gave 3 OPTIONS to
the GENERAL - Withdraw your petition or we have to pass orders!
The SUPREME COURT is NOT THERE to act as a WING of the GOVT -
Actually, there is NO DIFFERENCE between what the GOVT said and what
the SC said!!!
The ISSUE:
The DISCONNECT/LACK of SYNC between the AGs branch and the MS branch
about the Date of Birth and also that the MS branch had DONE so WITH a
MALA FIDE INTENT!
These judges, who seem to sit in an ivory tower and instruct everyone,
have hurt the image and honour of the Army Chief by getting fixated on
"HIS UNDERTAKING about his DOB given to the Govt at the time of his
appointment as the Chief"! The judgement seems to have brushed aside
the contentious issue of the use of BLACKMAIL to exact such an
undertaking. Many other STRUCTURAL ISSUES like the abounding
discrepancies between the ADJUTANT GENERAL(AG) branch and the MILITARY
SECRETARY(MS) BRANCH need to have been looked into and set right -
There seemed to be a conflict in the remit of these wings! The MS
branch was
GEN VIJAY KUMAR SINGH(the first COMMANDO to have become the CHIEF) had
taken effective action against many of his ERRING PEERS and SENIORS as
corroborated by the dismissal of Lt Gen Avadesh prakash and lt gen P K
Rath in Sukhna land Scam. Gen Singh also did NOT overtly come to the
aid of his predecessor Gen Deepak kapoor when he was caught on the
wrong foot! All this, in conjunction with the prejudices of several
other officers led to an ACTIVE NEXUS against the GENERAL. "A
PRE-DECIDED SUCCESSION PLAN " - an arrangement ostensibly worked out
between the GOVT-BUREAUCRACY and the RETIRED GENERALS was already in
place and Gen Singh was proving to be a stumbling block! Such NASTY
ARRANGEMENTS should be NOTHING NEW to the BUREAUCRACY and the
POLITICAL EXECUTIVE - A BUREAUCRACY(Read as the IAS) which is
CONSISTENTLY RANKED to be ONE OF THE WORST in ASIA always fires over
the shoulders of the POLITICAL ESTAB!

In 2007, when the general was raising the age issue within the army –
where the Military Secretary’s Branch (MS Branch) and the Adjutant
General’s Branch (AG’s Branch) had different dates on their records –
the ministry of defence (MoD) was taking a serious view of his refusal
to accept the MS Branch’s view.(Lt GEN Avadhesh prakash was the MS
BRANCH chief)
Bimal Julka, then Joint Secretary in MoD, wrote a stern letter to the
army that if Singh was going to keep raising his age issue, “the
question of suitability of Lt Gen VK Singh as army commander calls for
a revisit.” Julka claimed it was “an oddity that the officer has
continued to stand by a date of birth which is not officially
recognised and thereby revealing an attitude apparently questionable
and not reflective of the qualities expected from an army
commander.”(A MEASLY Joint Secretary(Ministry of Defence) has the dare
to write this)
It was this message that forced Gen Singh to sue for peace – since the
implied threat was clear. If he did not accept, he would not be
promoted. So he wrote to his bosses: “I have total belief in the
system as also great faith in the sagacity and wisdom of the
organisation I have been serving. Therefore, anything which is
required to be done in the larger interests of the organisation may be
undertaken by the HQ.”
A few days later, the then army chief, Gen Deepak Kapoor, apparently
reemphasised the consequences of him sticking to his story on date of
birth, and Singh again capitulated on 24 January 2008: “Whatever
decision taken in the org interest is acceptable to me.”(WHY did the
GENERAL have to do this IF NOT for some pre-planned Succession
arrangement/extraction of some other compromise?)
Here the GENERAL went wrong in ACCEPTING the ORDER - But, the SUPREME
COURT got FIXATED ENTIRELY over this issue which is ALSO WRONG!!
The GENERAL has committed another WRONG by WITHDRAWING his PETITION
sensing an adversarial verdict from the SC - This is SURRENDER - A
SOLDIER NEVER SURRENDERS - he DIES or faces HONOURABLE DEFEAT!
Just PICTURE the 24th January 2008 ORDER of the Govt:
24th january 2008 order of the Govt threatening Action and STALLING
PROMOTIONS if not complied with! - AND ours is a DEMOCRACY!!!
WHAT MESSAGE does THIS send OUT:
1. So, the govt can do anything, not follow any procedures etc while
other prongs have to follow its diktats......Wasn't the objective of
the HAZARE MOVEMENT to undercut this SUPREMACY of the GOVT?
2. if you want to move UP the ranks, then BOW, BEND and CRAWL to the
diktats of the Govt which are OFTEN WHIMSICAL and based on AVARICE -
NOT based on your PROFESSIONAL COMPETENCE and CALIBRE!
The Govt and some of our MISPLACED "PAKISTANI LOVERS" would tout it as
the VICTORY of the CIVILIAN over the MILITARY and that "WE ARE NOT
PAKISTAN"(Always assessing INDIA wrt Pakistan as they are fixated with
Pakistan). they DO NOT realise that the INDIAN ARMY is VERY DIFFERENT
from the PAK ARMY as it is INDIAN!!!! they also DO NOT realise that
the BALANCE between the MILITARY and the BUREAUCRACY is heavily skewed
in the latter's favour and it is IMPERATIVE to RESTORE the BALANCE
given that INDIA's POWER is EXPANDING!!
The BIGGER ISSUES which the COURT should have addressed as the GOVT
had FAILED to do so:
SHOULD the SUPREME COURT have NOT ADDRESSED THIS? Lets see what the
SUPREME COURT SAID in its JUDGEMENT as an ADVICE to the GENERAL -
"MOVE WITH THE WIND" - HOW bizzarre! Is this what the Supreme Court
is expected to say? Why could NOT the SUPREME COURT take a holistic
view in the GEN V K Singh's case?
SHOULD the SUPREME COURT have NOT addressed the DISCONNECT between the
Ag and the MS branches?
The GENERAL surely would have felt LET DOWN and SHOULD RESIGN
IMMEDIATELY! of course, the CIVIL-MILITARY relations WOULD HAVE SUNK
FURTHER with the CIVILIAN BUREAUCRACY running roughshod over the
MILITARY - the MORALE of the MILITARY surely would have got affected!
The SYSTEM ALWAYS WINS!!!!!!!!
