Dear Friend,
On the morning of 21st December 2007, around a hundred factory owners of
Mayapuri Industrial area went on rampage through the industrial area in the
name of a 'rally' against "trade unions." Armed with hockey sticks and led
by the President and Secretary of the 'Owners Association' of the area, they
en-route attacked the local office of IFTU (Indian Federation of Trade
Unions) situated opposite B-126 Mayapuri Phase –I. They entered the office,
broke the furniture, tore or carried away the workers' files, looted the
office and finally wrecked it completely, pulling down all the walls and the
roof completely. All this while the local police peacefully sat in the
thana, which is on the adjacent main road. It may be known that the office
had been in existence in the area since last 6 years. After wrecking the
office the owners swaggered around the area almost till 1pm.
This incident follows on the heels of the incidents in Mayapuri on the
20thof December, which the police and the administration are trying to
pass off
as 'rioting' by workers. In fact workers of 'Chelsa' establishment who were
taking out a rally along with workers of other factories with various unions
were attacked by the police and the owners. The design is to frighten away
and attack workers of Chelsa establishment from pursuing their months long
struggle, under various unions against illegal termination of services,
garbed as 'transfer.' Around 2400 workers of Chelsa were illegally removed
by the management of this textile export factory. The pro-management and
anti-worker Delhi government, through its labour department has refused to
take appropriate quick action despite a host of labour laws enabling it to
order immediate reinstatement, and has kept the issue boiling to aid the
owners to disperse as many workers as possible and denying them even their
due wage. After May 20th incident involving lathi charge on workers, false
cases have been registered against workers, and there is all likelihood of
their now being denied the right to enter the industrial area to sustain
their struggle.
The pulling down of the IFTU office in Mayapuri by the owners was abetted by
the police. When forced to have our complaint received with the police, they
repeatedly threatened IFTU activists. The Delhi Government through the labor
department similarly fully abets the owners in breaking labour laws with
impunity. Statutory laws of ESI cover, PF, Minimum wage, what to talk of
laws of illegal retrenchments, lie violated throughout the area. Police is
even willing to oblige by breaking up struggles, attacking workers.
Regarding the textile sector, textile factory owners countrywide have been
citing cancellation of export orders from America due to rising price of
rupee and explaining away mass retrenchments. The National Committee of the
IFTU had last month demanded that permission for retrenchment be banned, all
jobs be saved, especially as the government had released over 2400 crore
rupees for subsidy to owners. IFTU also suggested expansion of home market
by bulk orders from governments for 'janta cloth' to be sold through PDS.
However, typically, neither have governments banned retrenchments nor are
the labour departments acting to defend right to job and uphold labor laws,
though the owners have been given prompt relief.
Indian Federation of Trade Unions has demanded:
· Withdrawal of all false cases against workers lodged on 20.12.2007.
· The functionaries of the Mayapuri Owners Association are arrested
for criminal trespass, looting and pulling down the IFTU office in Mayapuri
and criminal charges are lodged against them.
· Reinstatement of all workers of Chelsa with immediate payment of
back-wages and all dues is ensured by Delhi Government immediately.
We call on democratic individuals and organizations to oppose lawlessness
and goondaism of owners – police nexus against workers and their legitimate
struggles.
