As you may be aware by now that BMSSA has approached the Hon'ble High Court of Karnataka in order to put to rest the recent struggle between COA Vs AICTE in the battle for supremacy in regulating the courses in Architecture. So far the Highcourts of Delhi, Bombay, Madras and Andhra Pradesh have upheld that the COA is the only authority to regulate the courses in Architecture as the powers vested with it under a special act (Architects Act 1972) cannot be overruled by any other subsequent acts.
The Hon'ble High Court of Karnataka has granted us (BMSSA) relief through an Interim Order in the case no: WP 44264 of 2011 (GM-EDN). The Interim order has stopped the VTU from withholding the results of BMSSA students till BMSSA obtained the AICTE approval in addition to the COA approval. As the petion copy is bulky, I'm not able to scan and mail the same to you at this point as per your request. You may obtain a certified copy of the petition and the Interim order from the High court registry though.
I would like to take this opportunity to take up this issue of warring factions of Ministry of HRD to safeguard the courses in Architecture in the State of Karnataka. As all of us are aware the issue is as follows:
1. COA and AICTE regulations do not match. (COA intake in multiples of 40 as against AICTE intake in multiples of 60 is one example)

2. VTU operated with the AICTE guidelines for Engineering and COA norms for Architecture till recently. However last year it asked Schools of Architecture to obtain AICTE recognition and upon bringing to the VTUs attention that the COA and AICTE norms do not match, the Schools are instructed to get the recognition from both agencies in order to be affiliated to the VTU. VTU is not willing to take up the side of COA despite four High Court verdicts and would rather have the Courts in Karnataka tell AICTE what is right.
3. A Faculty of Architecture does not exist in VTU ever since its establishment, while the course in Architecture is referred to as ‘Architectural Engineering’
4. Most administrators in the VTU do not understand the way a Course in Architecture is conducted and always tend to equate it as another branch of Engineering. The reason for this being of 18 Schools in Karnataka, 13 are under the Principals of Engineering colleges. The Principals of Engineering Colleges, are signing Form A, B and C of COA, without having a COA Registration number. This is illegal. As per COA norms, these 13 Schools need to be separated from Engineering. At present there are only 5 stand-alone Schools of Architecture. Also COMED-K is a consortium of Medical, Engg. and Dental Colleges and it is assumed that Architecture is a part of Engineering. The Directorate of Technical Education, GoK has no representation for Architecture so far.
In this backdrop, I request your co-operation and active participation by bringing about the following reforms:
1. Set up a body to safeguard the Schools of Architecture in the State of Karnataka on the lines of MASA (Maharashtra Association of Schools of Architecture).
2. The proposed body may bring the anomaly to the notice of the Hon'ble Governor (Chancellor- VTU) and the Minister for Higher Education (Pro- Chancellor- VTU).
3. The Proposed group may draft a note pressing for a State Cabinet decision setting up a separate University for all creative disciplines (Architecture, Fine Arts and Design).
4. The proposed body may engage in development of consensus amongst the bodies that regulate courses in Fine Arts (Lalit Kala Academy) and Design (Product Design, Textile design, Fashion & Apparel Design).
5. Andhra Pradesh has already set up a University for Fine Arts and Architecture
(JNAFAU), we may obtain more information from AP.
6. Karnataka is in the forefront of establishing 'Specialized Universities' in the recent past. Some of the leading examples are: University for Law (based in Davanagere), University for Women (based in Bijapur), University for Veterinary Sciences (split from UAS, Bangalore, based in Bidar), University for Horticultural Sciences (split from UAS, Bangalore, based in Bagalkot), University for Nursing and Paramedical Sciences (split from Rajiv Gandhi University for Health Sciences , Bangalore, location undecided), University for Kodavology, Madikeri.
7. GoK is on the verge of a 'Art Hub' and Museum at Roerich Estate on Kanakapura Road, Bangalore. The memorandum to the GoK for cabinet resolution may also request usage of the Roerich Estate premises for setting up of what may be tentatively referred to as: 'University of Fine Arts, Architecture and Design', complete with a Hitech campus, accommodation, galleries and auditoriums.
