This tab contains the Land Quality Division's "Guidelines" for coal and non-coal operations. The following is a break down of which Guidelines apply to what type of operations (coal, non-coal or both):

Guidelines are based upon applicable provisions of the Environmental Quality Act, LQD Regulations and they contain statements of LQD policy and preferred procedures. Except for specifically referenced statutory provisions and regulations guidelines are not subject to rulemaking procedures and are therefore not to be interpreted as regulatory requirements. The documents below are guidelines only and should not be interpreted by permittees, interested parties, DEQ/LQD staff or other local, state or Federal governmental agencies as mandatory.

** Please note that Guideline 1 is currently under revision but the information regarding overburden remains applicable until the completion of Guideline 1B. Sections regarding topsoil and subsoil have been superseded by Guideline 1A and the information contained in Guideline 1 should be disregarded for those sections. Guideline 1A may be viewed below.

The Land Quality Division (LQD) regulates blasting in surface coal mining in Wyoming, and has a Memorandum of Understanding (MOU) with Wyoming Mine Inspector for all other mining operations in the state.

The LQD schedules three-day Blaster Certification Training classes throughout the state during the calendar year. Below is a list of upcoming training courses. Contact the Blasting Program Manager, Reo Barney, for additional information.

Wyoming DEQ-LQD has hosted a series of Webinars that were previously recorded and can be used for up to sixteen (16) Blaster Continuing Education Hours (BCEH). There is no charge for the Webinars and are available to blasters outside of Wyoming.

Step 2: Complete the Wyoming DEQ Webinar Affidavit of Attendance. Multiple blasters and multiple Webinars can be placed on the same Affidavit of Attendance. Please indicate if a Blaster needs a Certification of Completion (not required for Wyoming Blasters).

There are two components to the California Air Resources Board's (CARB) abrasive blasting program; the registration of portable equipment used in the application of abrasives and the certification of abrasive materials. Certification is required for abrasives used for permissible dry blasting outside of a permanent building. Abrasives that are not the same chemically and physically, are not the same grade, and are not mined and produced at the same location, using the same processes, are certified separately.

A yearly blasting permit is required by blasting operations to use or store explosives. This permit is good from January 1 to December 31 each year. Whenever a blasting shot is planned, this office must be notified a minimum of 2 hours in advance as to date and time of each shot. Any deviations from the permit will be in violation of County ordinances.

MEETING SCHEDULE: The Blasting Advisory Board meets on the third Monday of the month at 7:00 p.m., subject to change. Meetings are held in Town Hall (6601 Main Street) in the Community Conference Room, Room 106. Special meetings are called as needed.

Over the years, the Town has attempted to limit blasting but to no avail. The jurisdiction and regulation over blasting activities do not rest with the town nor the county but with the State of Florida.

The State has established a process for complaints to be filed. It is very important you take the time to file a complaint as the last time (2015) we addressed this with the state they only had two complaints on file over the last several years.

In April 2021, the State Fire Marshal created a website to promote transparency and accountability with respect to enforcement actions against construction materials mining activity that does not comply with Florida law. This website allows you to submit complaints regarding non-compliant construction materials mining activity, and view the status of complaints submitted to the Division of State Fire Marshal regarding construction materials mining activity occurring in Miami-Dade County.

Bill 472 provides an exclusive administrative remedy through the Division of Administrative Hearings (DOAH) solely for the recovery of damages to real and personal property caused by the use of explosives in construction mining activities. Recovery of damages for personal injury, emotional distress, or punitive damages is excluded from this administrative forum and must be pursued separately in court. The administrative remedy for the alleged real or personal property damage must be sought no later than 6 months after the damage occurred.

Within 5 days of filing the petition, the case is assigned and an order is issued directing mandatory nonbinding mediation to be held no later than 60 days after the mediator is selected by the parties or the administrative law judge. If no settlement is reached within 15 days of the concluded mediation, the matter may be set for an expedited summary hearing upon mutual agreement of the parties. If the parties have not reached a settlement within 30 days of the concluded mediation, the matter is set for a formal administrative hearing.

Blasters will no longer receive retraining credit for attending the 30-hour class. This class is reserved for those blasters desiring the entire 30-hour session. The branch will teach courses specifically geared toward retraining for credit hours needed to obtain renewal.

The Explosives and Blasting Branch responds to all public complaints that concern ground vibrations, noise, flyrock and other adverse effects of blasting. The investigation of these complaints involves inspection of the operation generating the complaint and extensive seismic monitoring. The branch makes over 200 investigations of public complaints annually and uses the seismograph to resolve the complaints.

The requirements for the control of airblast and ground vibration for blasting operations is applicable to those recorded at the location of private dwellings, public buildings, schools, churches, and community or institutional buildings not owned or leased by the person conducting or contracting for the blasting operation.

Note: A property owner may register a complaint with the Office of the Fire Marshal, and if considered necessary, measurements on 3 consecutive blasts, using approved instrumentation, may be ordered near to the structure in question.

There will be three air horn signals sounded one minute prior to each blast followed by one prolonged air horn signal after each blast is deemed all clear. On average each blast duration is 500 milliseconds, equivalent to half of a second.

Ground vibration and air blast will be measured with seismographs located on the West and North side of the subdivision property. All drilling and blasting operations will be conducted in accordance with:
