Merlin? ... Brenton Slough DALLAS

Watched what we think was a Merlin down at Brenton Slough this morning. Mostly sat in a dead tree but made one very intent dive (which was not successful) for a bird on the edge of the road right in front of us. Couple of highly cropped photos enclosed.
