I would like to formally request for distributing this board note to
all HXNY Members ASAP. The note have been reviewed by all Board
Directors. Please let me know if you have any questions.

Dear HXNY Members:
No election means no choices for you to decide the next Principal and
PC Chair. The board heard your voices and will honor its
responsibility for an election on Sunday, June 19, 2011.
Here is the update message from school board for your reference.
1. The principal election is absolutely legal as the bylaws (item
9.01) clearly state that the end of school year is July 31st and the
election will go on as planned;
2. Board understands the members want a contested election therefore
board will hear from an additional pair of candidates (Dapeng Hu/
Yawen
Liu) and approve if they're qualified;
3. Regardless of who is elected, the board believes we will have a
set
of highly qualified members working tirelessly for the kids during
the
summer to make sure the registration and all other necessary
preparation will be complete when the school reopens in September.
4. Board appreciates members' desire to change the current bylaws.
Board will collect and consider all suggestions during the summer and
discuss bylaws amendment to be submitted to members for your
approval.
The board calls on all the members to come and listen to the
candidates and cast their ballot for the next Principal and PC Chair.
We look forward to your participation in the election on Sunday, June
19, 2011.

Here is the different board opinion:
After refusing two settlement proposals by neutral parties to
stabilize school this week, the board shall not send out a meeting
notice that is in violation of bylaw:
(1). There had been no legally eligible formal nomination by any
deadline, and no valid nominates to be reviewed. It is not fair to
other candidates and school members.
Shengjing Li had changed the deadline two times by sending “board
notice” without board reviews, and there had been no valid formal
nomination to the board even to the latest “deadline”.
(2). It is a rushed meeting not giving members needed time as
specified per bylaw
The Board meeting on which such nomination takes place shall be open
to all members in accordance with Section 6.04.3 set forth below
[5.04], and Such meeting’s agendas will be announced on the school
website at least one week before the meeting [6.04.3].

5.04 Nomination and Election of the Principal and Parents Council
Chair
The Principal and the Chairperson of the Parents Council are elected
by all members. Any school member can nominate candidates. Each
candidate must be clearly designated as for which position such
candidate is running. The Board of Directors shall, by way of a simple
majority vote in a Board meeting, approve no more than two pairs of
candidates for the positions of the Principal and the Chairperson of
the PC after review their plans regarding school operation. The Board,
after having decided upon the final candidates, shall then submit them
to the members for voting. The Board meeting on which such nomination
takes place shall be open to all members in accordance with Section
6.04.3 set forth below.
6.04.3 Board of Directors meetings to vote on resolutions and other
related discussions generally do NOT open to the entire membership
unless otherwise decided by the Board. Such meeting’s agendas will be
announced on the school website at least one week before the meeting.
Members wishing to attend the open Board meeting must follow the rules
of the meeting and have no right to vote and speak before they get
permission from the Chairperson.
