Dear HXNY members,
The school leader election scheduled on Sunday, June 12 was
unexpectedly delayed, then postponed until June 19, 2011 per request
from PC chairman Zhu Li. During the Q & A session on June 12
conference, your voices are loud and clear that HXNY members want an
election and make their own choices of school leaders for the next
school year. The school Board has heard your voices and will honor its
responsibility for an election on June 19, 2011.
Per Board resolution on June 9, 2011, a new nomination process was
opened up for one additional pair of candidates for this year's
election. Parents Dapeng Hu and Yawen Liu has submitted their vision
and working plan to the school board for supporting their candidacy.
They are also committed to do their best helping the school to
overcome this difficult time. Board shall review their candidacy
before the general election on Sunday, June 19, 2011. If it’s
approved, we shall submit the additional pair of candidates for
members to vote and make the final decision.
The graduation ceremony will be held in the White Plains high school
auditorium. The annual ceremony is the day for HXNY families to
celebrate the achievement of our children. We will keep the election
activities outside of the auditorium.
Here is the timeline on Sunday’s election:
· Venue (地点): Hallway outside of the White Plains high school
auditorium
· Time (时间): 9:10 am – 12:30 pm
Agenda as follows:
9:10 am - 9:40 am Board review and approve additional candidates
9:40 am - 10:30 am Candidates present their plans followed by Q & A
10:30 am - 12:30 am Distribute and cast ballots. Ballots will be
counted.
Notes on rules:
1) Only the Board approved candidates can be added onto the Ballot,
any ballot with unapproved candidates’ names on it will deem to be
invalid.
2) The membership consists of adult students (18 years old and over)
and parents or guardians of non-adult students, and permanent members.
3) To vote, you need to present your driver licenses.
4) Proxy is acceptable.

Dear all members,

This is to respond to the board's Request for election on June 19,
2011.

First I didn't postpone the meeting on June 12. It was the board that
delayed the meeting and due to time limit, it was impossible to finish
the agenda. It was clear and nobody should try to confuse and mislead
members.

It is clear in the bylaws that a meeting of member to elect the
principal and the chairperson of the parents council must be held at
least one week before the end of each school year (5.02.1). Based on
this, parent council will not violate the bylaws to conduct the voting
for such illegal election as it would be the last day of this school
year.

Bylaws 5.03.7 says that a voting committee shall be appointed by the
PC to conduct the voting. Based on this, any voting not conducted by
PC appointed voting committee is invalid and illegal.

As discussed in the board meeting and notes, the meeting you are
planning is in direct violation of bylaw, and not for the best
interest of most parent members. Unfortunately, you intentionally
removed the objections in your “board minutes” to parent members:

(1). It is a rushed meeting not giving members needed time as
specified per bylaw The Board meeting on which such nomination takes
place shall be open to all members in accordance with Section 6.04.3
set forth below [5.04], and Such meeting’s agendas will be announced
on the school website at least one week before the meeting [6.04.3]

(2). The 2nd “board notice” calling for nomination has been send out
by individual board member without a valid board resolution.

(3). There had been no nomination by deadline, and no valid nominates
to be reviewed. It is not fair to other candidates and potential
candidates Shengjing Li had changed the deadline two times by sending
“board notice” without board reviews. Also, there had been no valid
nomination to the board even to the latest “deadline”.
Please, listen to the voice of majority parent members, and work with
them to have the school stabilized.

5.04 Nomination and Election of the Principal and Parents Council
Chair The Principal and the Chairperson of the Parents Council are
elected by all members. Any school member can nominate candidates.
Each candidate must be clearly designated as for which position such
candidate is running. The Board of Directors shall, by way of a simple
majority vote in a Board meeting, approve no more than two pairs of
candidates for the positions of the Principal and the Chairperson of
the PC after review their plans regarding school operation. The Board,
after having decided upon the final candidates, shall then submit them
to the members for voting. The Board meeting on which such nomination
takes place shall be open to all members in accordance with Section
6.04.3 set forth below.

6.04.3 Board of Directors meetings to vote on resolutions and other
related discussions generally do NOT open to the entire membership
unless otherwise decided by the Board. Such meeting’s agendas will be
announced on the school website at least one week before the meeting.
Members wishing to attend the open Board meeting must follow the rules
of the meeting and have no right to vote and speak before they get
permission from the Chairperson.
