We would like to share an important awareness note on Quid Pro Quo Sexual Harassment as recognized under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
⚖️ How does the POSH Act, 2013 address Quid Pro Quo Sexual Harassment?
Under Section 3 of the POSH Act, 2013, quid pro quo sexual harassment refers to situations where a woman is subjected to unwelcome sexual conduct in exchange for employment-related benefits or under the threat of adverse consequences.
The phrase “ quid pro quo ” means “something for something” and, in the workplace context, includes:
* Demand for sexual favours in return for promotion, appraisal, transfer, or continued employment
* Threats of denial of benefits, demotion, termination, or unfavorable treatment if such favours are refused
Such conduct is explicitly recognized as sexual harassment under the Act, regardless of whether the demand is fulfilled.
