Urgent PIL request to protect Bangladesh Minorities

Dear Prof Ajoy Roy and Mr. Rabindranath Trivedi,

Considering the urgent nature of issue regarding the continued onslaughts against Hindus and other minorities in Bangladesh, I request that HRCBM-Bangladesh immediately file a writ before Country’s highest institution of justice requesting the followings:

  • 1.    Judicial Enquiry: The PIL should request the court to form a “judicial bench” to enquire with immediate effect on the allegations against political parties e.g. Jamat and BNP for their alleged involvement on atrocities against minorities.
  • 2.    Declaration of “Crime Against Humanity”: Let the court accept the criminal offense (the recent & prior onslaughts) against country’s minorities as crime against humanity under ICC statute for which Bangladesh Supreme Court is a complementary organ and Bangladesh is a state party.
  • 3.    Punitive Action & Compensation: Subject to Judicial Enquiry, the perpetrators of crime and their collaborators, irrespective of party affiliations be held responsible and in cases where involvement of political parties can be established or allegation against them are founded/reasonable on the basis of political interest on their direct or indirect incitement of violence against minorities in the country, let the court collect compensation (in addition to stringent punishment under the full extent of law) to rehabilitate affected people. The compensation must be reasonable that counts in tangible and intangible losses.
  • 4.    Instruction to State: The state should be held as a party to allegation of it’s failure to provide protection and immediate humanitarian services to the affected people. Court thus should held state administrations accountable and responsible for their inactions with full extent of law and instruct state to provide adequate humanitarian services considering the matter as internal forced displacement. Henceforth, instruction should spell out state party’s legal obligation under domestic and international laws and thus clear order should be given to treat internal displacement with utter importance declaring regional emergency in area affected.
  • 5.    Legal Protection from future attacks: Court should instruct the state to enact law or constitutional amendment to bar future attacks against minorities.  Such measure should be stringent and effective in it’s implementation.

Dear Prof Roy and Trivedi Babu, I request that you kindly pass this email to lawyer to incorporate these items in the writ and immediately appeal to the Supreme Court of Bangladesh. I do not think logistics to support such writ is an issue and thus, please consider it with utmost importance. I have talked with HRCBM-Sylhet to discuss this matter with you as Rakesh babu was readily available to answer the call. He is passionate to get this moving.


I am counting on your cordial help and leadership. Please impart the step moving forward, we should have this writ file by end of the week or early next week.
