Welcome to MAHARASHTRA CHS RTI UNION.
I am sure that publishing of MCS Bye Laws under 97th Amendment or otherwise for official purpose is only entrsuted either to the Commissioner of Co-operative Department or to The Mumbai District Co-operative Housing Federation Ltd. I would like to know if MSWA is also authorised to publish the same OFFICIALLY on behalf of "The Mumbai District Co-operative Housing Federation Ltd." or the Government for legally submitting the same to the Co-operative Housing Department from the CHS. If yes, kindly furnish relevant documents or please stop misguiding our members of this forum. Your comments on the matter on the forum will be highly appreaciated.

One can make use of KABUTARKANAS also situated at various places like Dadar, Girgaum, Bhuleshwar etc. If not, lodge a complaint with local police station about nuisance and with Health Department of BMC (MCGM) about health hazards with the attached article till the time a proper resolution is passed in a General Body Meeting.

We had some what similar case in our society. One gentleman, a senior citizen, living on 6th floor used to feed " Bhavnagari Ganthia" to crows every morning to earn "Punya" at the cost of the members living below his flat by using their Chhajjas for throwing "Punya Packages". While I was Secretary, I requested him many times to go to Juhu beach or to any open place and earn as much Punya he needed without creating nuisance to any members in the society. When he did not yield to the requests, we used the flat of a member living on 7th floor just above him and started dropping Bhavnagari Ganthia on all his Chajjas.and repeated the same thing what he used to do. Within three days he stopped feeding crows for ever there after.
Tit for Tat. No resolution, no Deputy Registrar, no Bye Laws, no Police, no Courts. If not possible to retaliate or not getting result, then Ad.S. Jain's advice: "u can pass resolution in AGM for penalty/fine and approach the police also but police should take the matter".

A member of our society has been feeding birds by throwing feeds from his flat on the pathways inside the society complex daily at 6.30AM. The shrieking noise of the hundred of crows disturbs the early morning sleep, peace and tranquility of the complex, makes the area dirty and attracts cats that kill the birds at times.
This practice has been objected to by many members. The MC was approached who have written to the member and also issued a show cause notice to him and drawn his attention to byelaw 166 of the model bye laws 2009.
The member is not bothered and has not stopped the practice.MC says it will bring the issue during AGM scheduled in Aug for approval of penalties on him.
Canⴠthe MC take recourse to filing FIR against him with reference to byelaw 50 and 175(E) (a) as he is using the open space in the society premise without the permission of the society and causing nuisance by the unauthorized use of the common space?
