I’m not a lawyer, but as per information I’ve, taking possession without Occupation Certificate (OC) is illegal in Mumbai (remember Coca-Cola Case) and many cities. Govt/authority may not provide the water/electricity/gas connections to flats or charge penalty for living in a building without OC. However in special cases, builders can offer possession based on Temporary Occupation Certificate (TOC). These rules vary city to city. But our case, this can be taken care of, if Noida Authority allows us by providing a TOC to AGC.
For us, NGT came into picture in the month of Aug’13 when a gentleman filed a PIL against high rise construction in Noida. If AGC would have completed the construction before Aug’13, Noida Authority would have given them the Completion Certificate (CC)and there would have been no issue. As they got late, Noida authority can’t issue them the CC now because case is pending with the NGT. Post CC, they need to get the OC from Authority as it is a multi-story building. Legally, Once OC is obtained by builder, then only they can offer possession to buyers.
None of the builder in Noida within 10 kms radius of Okhla Bird Sanctuary can obtain CC from Noida Authority as the case is still open with NGT. Please remember, there are more than 100 builders (49 old and 52 new) involved and media is having keen eye on the news, so Noida Authority will not provide OC easily. But as a special case, we should ask AGC to get TOC so that we can get the possession and move into our houses. If we’ll pressurize AGC, they will follow up Noida Authority to get the TOC.
We all should go and meet senior AGC officials and ask them to get the TOC from Authority, so that they we can move in our houses after taking possession legally.
They will not hear in individual voices, so we all should go together.
