Dear All,

Have finalised the MoA and am positng it ( have incorporated all
changes that were suggested).

The Association will be registered under UP Societies Registration
Act.

The Act prescribes a fee of Rs. 1000/-, however, will have to see if
the govt. has increased this. When we make the actual payment we will
ge a reciept for the same so it should not be an issue.

Have also been told by a local guy that we may need to pay some
4000 / - - 5000 / - to the officials (bribe) to get work done.

Am consulting a local agent and figuring out how we can get this done
in least amount.

The Office of Sub Registrar is in Mohan Puri, Merut. NOIDA is under
the division Merut.

I am told that though the act prescribes 7 members it is better to
have atleast 10 initial members as gives comfort to the official.

Will post the final expenses today by evening. Then we can proceed to
take every one's signatures.

Hi All,

Mr. Vineet Sharma promised to get back to us with all the details of clubs and it's amenities by 28th August. Has anybody received the details? If not then it shows how much the builder is careless about it's customers.

Also as per the new Apartments Act, the builder is bound to give the following details to the customer:

1. The plans and specifications approved by or submitted for approval to the local authority of the entire building of which such apartment forms part;

2. Detail of all common areas and facilities as per the approved layout plan or building plan;

3. The nature of fixtures, fittings, and amenities, which have been or proposed to be provided;

4. The details of the design and specifications of works or and standards of the material which have been or are proposed to be used in the construction of the building, together with the details of all structural, architectural drawings, layout plans, no objection certificate from Fire Department, external and internal services plan of electricity, sewage, drainage and water supply system etc. to be made available with the Association;

Thank you Shilpa for your guidance and efforts in getting the MoA finalized. Now it is to take a legal shape. Lets keep the momentum on and bring more people together.

I am glad to join this association but I have not entered my name in the list as I am abroad and can not join you for registration process phisically (neither I have representative available in Delhi). Let me know if it is OK to add my name there.

Let me know how to pay for the association member ship fee.

I am sure this association can make a difference and will be beneficial for every resident of Homes121.

Hi Shilpa ji. Need to know the address and membership details of Association. We are grave victim of sheer apathy of the builder, lost lakhs individually on delay alone. Now thet are proposing penal interest and other measures to cheat more. Lets be togather and fight them in court of law.....

Dear Anuj ji, we did not form a association at that time, as most people did not want to take legal action, they wanted to resolve the issue through discussions and meetings with builder. If you see the email is an old one.

I still believe in legal action..we are being fleeced of our money due to immense delay in completion of project.

The talk ...that too in unstructured way will not move even a finger. Unless there is something to be feared of consequence, nobody is going to move out of its own comfort zone.
just like Janlokpal came into being only after Delhi was lost to AAP. not because of Jantar Mantar or fasts.

There is no way any meeting going to help any one. The cheated must be willing to get even or just stop pretending. Each one of the flat owner has lost 25 lacs.

I’m not a lawyer, but as per information I’ve, taking possession without Occupation Certificate (OC) is illegal in Mumbai (remember Coca-Cola Case) and many cities. Govt/authority may not provide the water/electricity/gas connections to flats or charge penalty for living in a building without OC. However in special cases, builders can offer possession based on Temporary Occupation Certificate (TOC). These rules vary city to city. But our case, this can be taken care of, if Noida Authority allows us by providing a TOC to AGC.

 

For us, NGT came into picture in the month of Aug’13 when a gentleman filed a PIL against high rise construction in Noida. If AGC would have completed the construction before Aug’13, Noida Authority would have given them the Completion Certificate (CC)and there would have been no issue. As they got late, Noida authority can’t issue them the CC now because case is pending with the NGT. Post CC, they need to get the OC from Authority as it is a multi-story building. Legally, Once OC is obtained by builder, then only they can offer possession to buyers.

 

None of the builder in Noida within 10 kms radius of Okhla Bird Sanctuary can obtain CC from Noida Authority as the case is still open with NGT. Please remember, there are more than 100 builders (49 old and 52 new) involved and media is having keen eye on the news, so Noida Authority will not provide OC easily. But as a special case, we should ask AGC to get TOC so that we can get the possession and move into our houses. If we’ll pressurize AGC, they will follow up Noida Authority to get the TOC.

 

We all should go and meet senior AGC officials and ask them to get the TOC from Authority, so that they we can move in our houses after taking possession legally.


They will not hear in individual voices, so we all should go together.
