HAVE YOUR SAY! DRAFT STREETS, PUBLIC PLACES AND PREVENTION OF NOISE NUISANCE AMENDMENT BY-LAW, 2021

The City of Cape Town is in the process of amending the Streets, Public Places and the Prevention of Noise Nuisances By-law, 2007.

There have been considerable developments since the promulgation in 2007, including but not limited to, the expansion of the peace officer powers for law enforcement officers in 2018, the implementation of stringent standard operating procedures subsequent to challenges that the City and its citizens are confronted with as well as strategically aligning by-laws generally in accordance with guidelines ensuring efficient implementation. The amendment will also qualify certain provisions, thereby addressing constitutionality concerns and provide for obligations in respect of conduct relating to the abuse of powers.

Within the context of the abovementioned, the amendment deals with adding and streamlining procedural aspects that will underpin necessary action for:
• The effective resolution of complaints and situations detracting from the ordinary person’s rights to reasonable peace, enjoyment of public open spaces and facilities and
• Ensuring that risk to the City, individuals and land owners are mitigated in that necessary and ongoing processes/actions are supported by legislation.

In terms of section 17 of the Local Government: Municipal Systems Act, Act 32 of 2000,
the public and interested parties or groups are given the opportunity to submit comments, recommendations or input on this draft by-law to the municipality from 29 May to
30 June 2021.
