South Jersey USPS District Slams NRLCA Representatives
State Steward Michael Swain delivers the USPS slam
Friday, December 7, 2007 USPS South Jersey District Manager, Human Resources, Andrew Keen sent a dissemination to all post offices with rural delivery within the South Jersey District (including the entire state of Delaware) which basically said that the NRLCA cannot be depended on to get timely and accurate information out to craft employees and that supervisors should fill that void left by the NRLCA.
The actual cover letter is an extraordinary document that should defintely and could very likely be the subject of an “Unfair Labor Practice” under the terms of the National Labor Relations Act as well as a gross violation of the USPS-NRLCA National Collective Bargaining Agreement. The letter specifically explicitly and implicitly slammed the NRLCA for an inability to share correct and accurate information.
This is exactly the same complaint that this newsletter has raised for at least six weeks. The difference is that we as union members can criticize our union for its shortcomings; when USPS does it to directly undermine the union and steward relationship with craft members, it is an UNFAIR LABOR PRACTICE.
State Steward Michael Swain not only received a copy of the letter with the enclosures containing the Fishgold Arbitration Award and highlights of the Arbitration award, but he then distributed the USPS criticism to stewards and officers throughout the state.

As you have likely heard, the USPS and NRLCA recently received the interest arbitration award on the contract.
There are 3 attachments on this email. First is the entire award. Second is an outline of the changes. Third is the announcement letter.
This is a great opportunity to discuss and share this information with your rural carriers. Remember this is our contact and it belongs to both management and rural carriers equally. Take this chance to communicate with your carriers.
Remember that your carriers count on their immediate supervisor to be their prime source of information. Don’t let them get their info from the rumor mill, don’t make them wait to hear from their union steward, don’t make them wait till the next union meeting to get their info. Be their source for credible, accurate information.
The second attachment gives you an easy-to-present sheet to communicate the changes. Feel free to copy and share this info with your folks.

USPS is clearly telling managers that supervisors must be carrier’s “prime source of information” and not to make their carriers wait to hear from their union steward or wait until the next union meeting. Supervisors are specifically told to be their carrier’s “source for credible, accurate information”.
Rumor mill? Waiting for their union? Be their source for credible, accurate information? THAT IS THE UNION’S JOB! USPS is clearly saying that carriers cannot depend on their union for accurate, credible and timely information (exactly what this newsletter has maintained) and the NJ RLCA sent this poisonous letter out to their stewards, officers and members!
DOES THIS MEAN THAT THE NJ RLCA IS TAKING THE POSITION THAT NJRLCA INFORMATION IS NOT CREDIBLE, NOT ACCURATE AND NOT TIMELY AND THAT CARRIERS SHOULD GO TO USPS SUPERVISORS AS THEIR PRIME SOURCE OF CREDIBLE INFORMATION?
Does this mean that State Steward, Michael Swain, wants carriers to utilize USPS supervisors as their prime source of information? Does this mean that union information cannot be depended upon (his cover suggests that USPS information is likely better than what he had)?
If I was the state steward and received that letter, with no time spared, I would have been in Andrew Keen’s office demanding the letter be rescinded, corrected and redistributed; I would have protested, grieved and appealed in every venue to sanction USPS for writing and distributing that letter and I would have made sure that every carrier knew that USPS had grossly transgressed their legal boundaries.
One thing is for sure, the members would have seen the letter and they would have seen what the NRLCA was doing about it.
For people as thin-skinned as the NJ RLCA are about criticism, it must be especially galling to have USPS repeat the exact same criticisms I have been making and to send it out to every post office, to send it to the State steward charged with enforcing the collective bargaining agreement, postal regulations and labor law and then have the state steward casually distribute the USPS criticism to every steward and officer in the state of New Jersey.
The NJ RLCA apparently says not to depend on the union for accurate, timely or credible information; but that carriers should go to their supervisors because the Union can’t or won’t do its job. Then they go on to say that it may contain information that is not yet available to the Union. READ IT! READ IT BEFORE YOU SEND IT OUT! Drop everything, you have been exposed and called out by USPS as ineffectual and unable or unwilling to do your job. USPS says it and you sent the USPS slam out to everyone.
Do you even now know what USPS did and what you did to aid and abet how they slammed the union? I think the NJRLCA problems all of a sudden got a whole lot worse than members criticizing their union whether it be one member, 100 members or 1704 or 2200 members. WAKE UP, SMELL THE COFFEE! USPS slammed the NJ RLCA with particular savagery and you didn’t know it until you read it here!!!!! Problem! Big Problem!!!!!
State Steward Swain confirmation of Board Attempt to Sue John Amtsfield
In yesterday's edition of the NJ Postal and Rural News (Issue 29-NJ) this newsletter printed State Steward Swain's confirmation of the attempt to sue (litigation) John Amtsfield and mentioned that he took the position that there was nothing to gain by litigation. It is a far cry from advising that Unions cannot sue dues paying union members, that unions have a process in place in the C&BL to handle isues with members and that the Union should follow the proper procedures or even that in the United States of America people have free speech rights.
Swain's statement in the Internet communication is, however, confirmed by records of a September 21, 2007 meeting of the NJRLCA officers and state steward "Since it is over and done with, Mike S. said we shall leave it alone." There is a further reference after further discussion "Again Mike S. stated that while the emails were hurtful to him and his family and we all agreed that the sender stepped way over the line in content he did not want to pursue any action himself." (At least 3 officers tell me they did not agree!)
Despite Swain's position, the NJRLCA state board on September 21, 2007 tasked President Timothy Horner to contact "legal counsel" to determine what course of action to take relative to a campaign letter used by Candidate Bridget Boseak from Michigan in her campaign for NRLCA national office ("the letter appeared to slam our state, our officers and our steward system") with an endorsement from John Amtsfield who identified himself as a retired rural carrier. Bridget Boseak was running against Michael Swain in a field of about seven candidates in a race which Steven Traylor of Illinois eventually won.
No attempt was made to even talk to John Amtsfield (the NJ and National C&BL require that if charges are to be brought against any member in good standing (paid dues), a full invesigation had to be conducted, the member given a copy of charges and time to responde before an impartial hearing occurred.
The official reaction of the NJ RLCA prompted by State President Timothy Horner and with full accord of State Steward Michael Swain had no problem threatening the certainty of legal action whereby the NJRLCA was going to sue two dues paying union members, one a current state elected board officer and the second a former ten year state steward for New Jersey. Even now State President Timothy Horner suggests that Swain is considering legal action.
There is far more to this sorry story then is reported here, but it will be covered in future issues. Needless to say one state officer has written to say that the whole thing is really between Swain and Amtsfield and Swain is just making it worse, another has written and telephoned with regrets to tell my wife to keep up the good work and a third is upset that weird things are happening, people are isolating into groups and talking about all knids of crazy things. The State baord is coming apart at the seams.

In New Jersey I served as an administrative officer for the State Board from 1991-1992, Assistant State Steward 1992, State Board Members 1993-1996, State Steward 1993-2003, District Co-Chair QWL, 4 years on the NAJSC and a host of other positions including the first NRLCA National Steward Task Force.
My endorsement is not the result of any issues personally with any specific individuals with whom I maintain cordial relations and do not reflect any personal disputes. I am profoundly unhappy with the sadly deteriorating steward system within my state and particularly with how rural craft employees are treated.
I have worked with you in the past and know that you are a strong and caring advocate for all rural carrier craft employees. I think your approach to resolving issues is excellent and you have natural steward instincts which you have refined very well. Sometimes it is easy to identify those with whom their best work is yet to come from those who believe their level of achievement, however modest, is an entitlement for reward and have little likelihood or prospect of matching or exceeding that modest achievement. Your best work is ahead of you.
Even with state and regional loyalties factored into any decision I might make for endorsement of candidacy for National Executive Committeeman/woman, your qualifications and experience, your reasoned approach to negotiation, your independence, your strong advocacy for every rural craft employee, your ability to see the forest and the trees together and apart (all sides of an issue, possible repercussions and impact of possible solutions), your ability to forecast likely situations and issues before they reach critical mass and especially your sensitivity and empathy for rural craft employees, make any decision for endorsement a very easy decision.

Now, tell me what exactly so infuriated the NJ RLCA other than the fact that I endorsed a better candidate. This is the entire letter!
The endorsement letter was a draft email which I had intended to follow-up with a signed letter that was a little more polished. I asked to defer any action until after upcoming New Jersey meetings sheduled for May 25 and I asked that I be notified when the endorsement is used so that I could confirm what I had written. Circumstances intervened when the State Board essentially fird Diane Irrgang and I never followed up with the signed letter.
Please, let there be no misunderstanding! What I wrote in May 2007 I stand by 100%.
I was not aware that Michigan would use the letter as a handout at the 2007 National Convention and was not aware of it even afterward since neither my wife or I was in attendance at the National Convention. I have absolutely no issue with what Bridget's people did and fully support what they did.
I know some of the Michigan people have expressed their regret and astonishment by what is happening to me here in New Jersey and they are concerned. They have no need to be concerned. The people in New Jersey are behaving very inappropriately and no one in Michigan bears any responsibility for New Jersey misconduct, petulance and pettiness. The reaction by the officers and stewards simply reinforces and verifies what I have been criticizing them for doing.
I also want to mention and prominently single out my wife, Linda who was an elected board member until she resigned on December 3, 2007 when she accepted a management position. She has stood up to the pettiness and suffered tremendous traumatization when the officers and stewards ganged up on her. Like other committed people who cared about rural carriers and just wanted to help, she found it impossible to deal with the pettiness, the personal interest, the idiotic power plays and she was forced to submit her resignation as state officer, DJSC member and state insurance representative effective December 3, 2007. I AM VERY PROUD OF HER!
Now, remember that she resigned on December 3, 2007. Although the NJRLCA acknowledges receipt of her resignation letter, they are apparently not recognizing it as a resignation. So, although she has resigned; the NJ RLCA now has a management employee on their elected state board; which is a clear violation of Labor Law. It is there doing and they just have to do it the hard way and the stupid way.
