How to register ATV with no title

Surely, someone has been through this procedure before. I am looking for
advice on how to register an ATV I bought, into my own name, that did not
have a registration title with it. I'm nearly 99% certain that this ATV was
not stolen because, a) the person that I bought it from had 2 expired
permits from the previous owner he acquired it from, that he gave to me, and
b) there is a visible VIN tag on the front of the ATV frame that matches the
VIN on the expired tags that were given to me when I bought it.

So, here's what I know; the last owner that I bought it from did not
register the machine when he bought it. Whether it was because he was young
and careless, or just couldn't afford to, I don't know. This was a younger
person, around 20-25 years old and he and his girlfriend had just had a baby
2 weeks before he sold the ATV to me. Which was also his reason for selling
the ATV, financial purposes. But he told me in the 6 months that he owned
it, he never had it registered, nor had a plate for it. I do know his name,
and tried to contact him, but have yet to receive a reply. I also know the
name of the first owner the last guy bought the machine from, because I have
the expired permits in the first owners name. I have not tried to contact
this person. I'm guessing that he will tell me that when he sold the
machine, he sent in the sale part of the registration, but I don't know if
that is true or how I could find out. More than likely, the ATV is not
registered to anyone right now, but I have no way of telling for sure, and
I'm not sure what to do if it is.

So, looking at Access Nova Scotia's website, it directs me to this page,
http://www.gov.ns.ca/snsmr/rmv/registration/roadveh.asp,
and when you scroll down to where it says "How do I register my ATV with no
paperwork", it gives you a form to print and fill out, and says to contact
either the Department of Natural Resources, or your local Police Dept. Talk
to a Peace Officer who will check over the ATV and run the VIN number to
make sure it isn't stolen. So I went into the DNR in Windsor and the lady
in there had no idea what I was talking about. She wrote down my name and
number and told me she would talk to one of the other employees and get them
to contact me, and that in her knowledge, they had never dealt with this
kind of issue.

So I guess what I want to know is, what is my next step? Should I call the
Windsor Police Station, or is there a better way to go about this? Access
Nova Scotia has a toll-free phone number that I wrote down (I tried calling
it earlier, but I get off work later than 4:30pm, so it was too late).

Any advice or help by someone that has been through this would be greatly
appreciated.

I called Access Nova Scotia, 650 Portlant St several times in several
months and each person specifically told me not to purchase any item
without title papers as it could be stolen or the last registered
owner can call the police and say they want their item back. Be a
automobile, motorbike, snowmobile, trailer, etc. Same applies to
registered guns.

Then this defeats the person of having ownership papers, I am not
attacking you but this is what I was told repeatedly. I always see
people on Kijiji selling ATV's without papers and they always say they
are easy to get. I always tell them let's drive over to Access Nova
Scotia register it in my name and I will pay you they quickly run away
with their tail between their legs. Funny thing is after they take
your money they run, this guy WILL NOT GET BACK TO YOU.

Well, thankfully I'm a bit more optimistic than that. The way I see it, the
last owner that I bought it from obtained the expired permits from the first
owner, which means that he obviously received them from the first owner when
he purchased it. And so being the case, more than likely the sale form on
the registration certificate was filled out by both parties and sent into
the DMV. The last owner didn't even so much as go in and register the title
in his name, so it doesn't even look like he owned it at all. Meaning that
the title of this ATV should be open, there shouldn't be any owner
registered right now. When I get the paperwork straightened out and go into
get a new title, it will look like I was the one that bought the ATV from
the first owner. I really don't see any problems once I get the VIN number
ran by a Peace Officer and his signature, saying that he checked it over and
its good to go. This is what Access Nova Scotia has listed on their website
to obtain a new title, so there is obviously a way around it.

But yes, I see your side of the coin and I know that in general, it is not
advisable to purchase any vehicle without the proper paperwork. Funny thing
is, when I bought the machine, it was listed on Kijiji as having the
paperwork, and once he had handed me the expired permits, I hadn't checked
them and thought that he did hand me a registration title.

I'll get it straightened out one way or the other.

From my understanding, you don't have clear title because the chain of
ownership is broken. Owner 1 sells to Owner 2 who has to pay the
taxes at DMV on the purchase price (or value of the machine). This
will have to be done before you can legitimately purchase it from
Owner 2 as Owner 3. Guaranteed that they'll want their cut before this
goes a step further. As another poster said, the ownership isn't
open. Owner 1 still legally owns the machine unless he filed his part
of the sale registration papers to take his name off it, which you
don't know happened. Further, if Owner 1 had a loan for the machine
and there's an unpaid balance, there could be a lien on the machine.
I hope it all works out but you don't have much to back you up if
Owner 1 or 2 wants to screw you over.

you need to go to the last registered owner, and have them give you a
bill of sale to transfer the registration.

they can't just do you up a new registration

if you bought it -- tough luck, hope you get your money back from the
guy, or avoid the cops when transporting your machine

what kind of bike is it and what year?

it's one of the 200 or so ATV's for sale on Kijiji without papers, I
can't believe people sell ATV's without papers and cannot believe
people buy them. Maybe I will sell my car and after I get my money
contact the police and say I never sold it and want it back, maybe
even claimed the buyer stoled it.

This is pretty much a reply to all the posters. First of all, to the people
that posted information, how many of you have actually gone through this
process with a vehicle or ATV of your own? Because that is what I was
looking for, I've become tired of guessing what may or may not happen,
that's part of the reason I contacted the DNR, to find out for sure. I want
to hear from someone who has been through this process, and if they were
successful in getting new registration, how hard was it to do? I could sit
here for an hour an think of 5-10 different scenarios, but I want facts.

As far as the machine, it's a 1993 Suzuki King Quad. I paid less than $1000
for it, and I am 99% sure there are no liens. I mainly bought it for
plowing out my driveway and for yard work. I will use it for trail-riding,
thus the need for registration and a permit. As for the first owner wanting
the machine back, I highly doubt it. The second owner had it for 8 months,
I'm pretty sure that if he were going to reclaim the machine, he would have
done it by now. Plus, he had renewed the permit at least twice when he
owned it, meaning he's probably a fairly honest guy. As far as the original
owner is concerned, the younger guy I bought it from still owns it, he
doesn't know that I even bought it, and I'm sure he doesn't care either.
The fact that he gave the young guy two expired permits tells me that more
than likely, the sale part of the registration was filled out and sent in.

Once I hand the paperwork back into the DNR tomorrow and hear back from the
Peace Officer, I will update as to what is happening. But, to the one
idiotic reply, I have no intention of listening nor replying to your BS, so
knock it off. All I'm looking for is some factual info, not your childish
input.

We'll see how it goes in a few days once I hear back from the Peace Officer.

Hundreds of people have walked into or called Access Nova Scotia and
have tried to do things "by the book" so they are not chidlish and
again I was told all people were rejected in attempting to register
their ATV, car trailer, snowmobile, motorcycle, etc. If you think your
method works then GO LECTURE EVERYONE AT ACCESS NOVA SCOTIA and DNR.

If you want facts, you need to call Access Nova Scotia and ask your
question(s) to the person that takes your call.

Actually, no I don't. The DNR Peace Officer just came out and looked
at the ATV, ran the VIN and it came up as unregistered and not
stolen. He signed the forms, and now I'm ready to go register the ATV
into my own name at the DMV.

All I asked was a simple question and answers based on personal
experience, there was no reason for lashing out the way certain people
have. Next time, I won't bother asking on here. BTW Patton, I was
not referring to your post as being childish, I was referring to the
guy that told me to, "ditch the blasted thing and walk!!! Get some
exercise, stop polluting!", just to be clear.

You would have had the answer(s) to your question(s) faster. People
sometimes forget, that picking up the phone is a faster way to get some
answers to their questions, than wasting time looking for them on the
Internet.

I feel better now, LOL. By the way thanks for the update and CONGRATS
on your bike, I assume that was the one on Kijiji where he had it
advertised that it's was the cheapest King Quad for sale on Kijiji
Halifax? the one where he lives in Porter's Lake? if so that's one
clean bike.

Thanks. The ATV came from Bridgewater, it was listed for $1200, with
papers (so he said), new starter, solenoid, battery, and new piston
rings. Come to find out, the piston rings were in fact new, still in
the package. Meaning they wern't installed, and that the engine
needed a complete top-end overhaul. It also needed a fair amount of
work, all new brake shoes/springs, carb. put back together, 2 new CV
boots, and it still needs new fenders. I knew that it had been abused,
and I bought it with the intention of fixing it, since most of the
work was minor. Once I showed him everything that was wrong, he
accepted my offer, which was just over half of his asking price :-) .

Now that it's all back together and running, it works quite well. I
still haven't invested more than his asking price buying the engine
parts, and I did the rebuild myself, except for the head work. I'm
nearing the 10 hour break-in period, so it's due for an oil change.
Went to the DMV yesterday and got the new title and permit, so I'm all
ready to go for a run in the woods. I'll bring my tow-rope, just in
case.

I know this is an old post but and see sharky hasn't any activity but would be intrested in comments. I also tried to use the form refernced for for getting the title for an ATV purchased without any papers. I contacted the DNR officer and when he ran the VIN he told me it was previously registered and that I had to contact the previous registered owner to obtain the papers from him. I find it interesting that the ATV you purchased was also previously registered. Did the officer mention this. Also on the form did you have to fill the bottom portion where a declaration that the machine has never been registered.
