Klump testified that he had never heard about anything being stolen in connection with this case, and no stolen goods were ever recovered. The burglary charge was stetted on the day Reeves was sentenced for the rape conviction
We point out that, although silent on this specific point, Judge Thomsen's finding that either the mother or the niece wrote the note and placed it in the bureau drawer is inconsistent with any knowledge of or consent by Reeves to the use of his bureau for the purpose of storing the note, since testimony credited by the court below was to the effect that the note was prepared in response to a suggestion to the mother by police officers made at least after the petitioner had been arrested and probably even after he had been jailed.
