The Myth of the Level Playing Field: WTO Jurisprudence and China

When raising complaints about China’s trade practices, commentators frequently raise concerns about how Chinese policies distort the “level playing field” for foreign firms.  But is the playing field actually “level” to begin with?  Mark Wu will examine how recent World Trade Organization jurisprudence has confirmed the permanent nature of the uneven playing field, at least from China’s perspective, and raises questions about what this may mean for Chinese compliance.

Mark Wu
is assistant professor of law at Harvard Law School. Prior to joining the faculty in 2010, he was an academic fellow at Columbia Law School and a law clerk to Judge Pierre N. Leval of the US Court of Appeals for the Second Circuit. He has served as the director for intellectual property in the Office of the US Trade Representative, where he led negotiations on the IP chapters of various free trade agreements. In addition, he worked as an engagement manager for McKinsey & Co., as an economist and operations officer for the World Bank in China, and as an economist for the United Nations Development Programme in Namibia. Wu’s recent publications include:
"Antidumping in Asia's Emerging Giants," Harvard International Law Journal 101 (2012); "China's Currency Isn't Our Problem," New York Times, January 18, 2011, Op-Ed; and The Law of the World Trade Organization (2010), with Petros C. Mavroidis and George A. Bermann.
