A Sydney magistrate has found 2GB broadcaster ALAN JONES broke
the law .. by naming a child witness at a murder trial.
Deputy Chief Magistrate HELEN SYME has also found Nationwide
News .. the publisher of The Daily Telegraph .. breached the
Childrens Criminal Proceedings Act by publishing the boy's name in
2005.
The legislation is designed to protect juveniles in criminal
proceedings .. and prohibits the naming of witnesses under 18 ..
without their consent or authorisation by the court.
The boy was allegedly aged 14 when he witnessed a fatal attack
in 2004.
After he gave evidence at the trial of the alleged murderer in
July 2005 .. his name was reported in The Daily Telegraph and on
JONES' morning radio show.
JONES .. 2GB licensee Harbour Radio .. and Nationwide News have
faced a hearing in the Downing Centre Local Court.
The witness has told the court he didn't give anyone permission
to publish or broadcast his name.
Although prosecutors couldn't prove his exact age .. Ms SYME
says evidence shows he was born between 1988 and 1992 .. and she
accepted he was under 18 at the relevant time.
JONES had told the court he assumed some form of consent had
been given to name the juvenile .. because he saw the article in
the Daily Telegraph .. and considered the newspaper to be
responsible and reputable.
But Ms SYME has noted there was no evidence the newspaper story
suggested that consent for publication had been obtained.
She's found the breach proven against all three defendants.
A hearing on possible penalties will be held next month.
