Sydney-based commercial radio broadcaster, Alan Jones, has been found
guilty of breaching the Children's Criminal Proceeding Act by naming a
child witness in a murder trial.

Jones made the broadcast on 2GB in July 2005.

Sydney's Downing Centre Local Court heard that Jones based the
broadcast on details published in The Daily Telegraph newspaper.

Jones told the court that he was aware that consent had to be obtained
to broadcast the name, but that he presumed that the newspaper would
have done so.

The court also heard conflicting evidence about the true age of the
witness.

Magistrate Helen Syme has found that the boy was aged under 18 at the
time and she has rejected Jones's explanation that he thought consent
had been given.

A sentencing hearing has been scheduled for April.

The publisher of The Daily Telegraph, Nationwide News, has also been
found to have breached the law.
